The Sejm adopted an act introducing a safe loan and a housing account

On Friday, the Sejm passed the act on state aid in saving for housing purposes, which introduces the First Apartment program. Its two pillars are: a “safe loan” with state subsidies to installments and a housing account with an additional housing bonus from the state budget.

The Act also allows for indexation of subsidies to rent under the Mieszkanie na start program. In addition, it limits assignments of reservation and development contracts, and increases this year’s spending limit on social and municipal construction. Provisions enabling the payment of compensation to entrepreneurs in connection with the closure of the border crossing in Bobrowniki have been added to the Act.

The opposition’s amendments were rejected

Pro bill with three club amendments PIS 386 MPs voted, 48 were against and 15 MPs abstained. Two of the adopted amendments are editorial, the third extends the catalog of persons entitled to take a safe loan to persons who received real estate by inheritance or donation and sold it before reaching the age of majority. The opposition’s amendments were rejected, including the proposals of the Civic Coalition that the 2 percent loan should be to convert into a 0% loan, and to freeze the installments of housing loans at the level of December 2021. The amendments of the Polish-PSL Coalition were also not supported, e.g. so that large families could take out a larger amount of “safe credit”, and that BGK would grant a guaranteed subsidy to the borrower in the amount of PLN 100,000. PLN for the purchase of a house or apartment.

Cheap credit

According to the Act, a secure loan with a periodically constant interest rate a person up to the age of 45 will be able to enlist; if the loan is granted to both persons running the household, the age condition will have to be met by at least one of them. The loan may be granted only for the first apartment – persons belonging to the borrower’s household will not be able to have, on the date of granting the loan or in the past, an apartment, a house or a cooperative right to an apartment or a house.

The amount of the “secure loan” cannot exceed 500,000. PLN or – if the borrower runs a household together with his spouse or has at least one child – PLN 600,000. zloty. Own contribution cannot be higher than 200,000. zloty. In the absence of own contribution or incomplete contribution, it will be possible to use the guarantee of Bank Gospodarstwa Krajowego.

The subsidy to the installments will be due for 10 years, and the loan will be repaid in the formula of fixed capital installments (decreasing capital and interest installments). During the period of application of subsidies, the loan interest rate, according to the explanations on the website of the Ministry of Development and Technology, will amount to 2 percent for the borrower. plus a margin, commission and other bank charges (if any). “Safe loans” will be granted by banks that will conclude an agreement with BGK in this regard.

Savings Account

The Act introduces a special savings account. Regular payments (at least 11 payments per year in the amount of at least PLN 500) will guarantee an additional housing bonus from the state budget. The bonus will be equal to the annual index inflation or the price change index for 1 square meter of usable floor space of a residential building. Each year, an indicator more favorable for the saver will be selected. Savings will additionally bear interest in accordance with the bank’s offer, while interest will be exempt from the so-called beam tax.

The next provisions are the indexation of subsidies to rent under the Mieszkanie na start program. These are payments made from the BGK Subsidy Fund through the communes that joined the programme. Subsidies may include: tenants of PFR Nieruchomości housing estates. At the same time, in the years 2024-2028, the act reduces the limit of maximum budget expenditure on rent subsidies under the Start-up Apartment by PLN 1.5 billion annually.

The provisions also aim at eliminating the possibility of trading in assignments of reservation, development and other contracts obliging the buyer to transfer the rights to a flat or a single-family house. A ban on the assignment of the reservation agreement will be introduced (except for the assignment made to family members). In addition, the possibility of assigning a development contract will be significantly limited. Apart from cases of assignment to family members, such an agreement may be assigned if it concerns no more than one residential unit and is made by the buyer who has not made a similar assignment of another development agreement within 3 years.

The limit of expenditure from the state budget for the program supporting the construction of municipal and social housing for 2023 will be increased from PLN 1 billion to PLN 1.5 billion.

Compensation for entrepreneurs

Provisions on compensation for entrepreneurs from the state budget in the event of a temporary suspension of traffic at the border crossing were added to the Act on the protection of the state border. They will be available to people conducting business activity in the area of ​​the commune in which the closed border crossing is located in the field of: gastronomy, currency exchange, retail sales and – also in the case of farmers – the provision of hotel services.

The condition for obtaining compensation will be a decrease in revenues in the month in which the temporary suspension of traffic at the border crossing was in force, by at least 50 percent. in relation to the income obtained in one of the two preceding months or in the same month of the previous year. In addition, you cannot be in arrears with tax and social security payments.

Compensation will be granted at the request of the entrepreneur or farmer submitted to the voivode. Its amount is to correspond to the amount of the minimum wage for each insured person reported to ZUS or KRUS. You will be able to receive support up to three times in a calendar year.

The regulations on a safe loan and housing account are to come into force on July 1 this year. Changes in the scope of reservation and development agreements as well as indexation of subsidies to rent in Apartment for starters will become effective after 30 days from the date of announcement. Compensations due to the closure of the border crossing will come into effect the day after the announcement.

The bill will now be sent to the Senate. Most of the provisions are due to enter into force on July 1, 2018.
