The Senate limited the group of payers of the so-called solidarity contribution from extraordinary profits from coal mining and coke production. In practice, this means that the new fee will cover only Jastrzębska Spółka Węglowa (JSW). The amendment was supported by the government. Its final fate will now be decided by the Sejm.

According to the amendment introduced by the Senate regarding the solidarity contribution from extraordinary profits from coal mining and coke production in 2022, it is to be paid only by companies employing over 3,000 people. employees, i.e. only Jastrzębska Spółka Węglowa. However, four other entities would be exempt, including Koksownia Częstochowa Nowa, belonging to the private Zarmen Group, and Victoria coking plant in Wałbrzych, belonging to the state-owned TF Silesia. This amendment was supported by the government.

The bill in the Senate was supported by all 97 senators participating in Friday’s vote.

Electricity price freeze 2023

The upper house also decided that they were frozen electricity prices in 2023, cooperatives and housing associations that previously concluded contracts with a guarantee of a fixed price of electricity are to be covered. The current provisions on the protection of electricity consumers exclude entities that have previously concluded such contracts from support in the form of frozen prices.

The amendment to the Act on the Protection of Electricity Consumers in 2023 raises the consumption thresholds to which household consumers are entitled to frozen energy prices. The new regulations provide for an increase in the limits:

  • for households from 2,000 kilowatt hours (kWh) to 3,000 kWh per year,
  • for households with a disabled person from 2600 kWh to 3600 kWh,
  • for holders of the Large Family Card and farmers – from 3,000 kWh to 4,000 kWh per year.

The new limits will be available in 2023, even if the electricity consumer has exceeded the current limit.

The amendment adopted in the Senate provides for raising the consumption limit to 6 kWh for users of heat pumps.

The amendment also assumes that from October 1, 2023, the maximum price for energy will be reduced from PLN 785/MWh to PLN 693/MWh (the amount excluding VAT and excise duty). This will concern: local governments; small and medium enterprises; sensitive public utility entities, such as hospitals, schools, kindergartens, nurseries, night shelters and care facilities for the disabled.

The Ministry of Climate and Environment estimated that the additional total cost resulting from the increase in limits and the reduction of the maximum price will amount to approximately PLN 3 billion.
