Due to the threat to the independence of the Supreme Audit Office at the international level, a special SIRAM procedure (Supreme Audit Institutions Independence Rapid Advocacy Mechanism) was launched, as requested by the President of the Supreme Audit Office, Marian Banaś. As tvn24.pl learned unofficially from a source in the Supreme Audit Office, on Thursday representatives of INTOSAI, the International Organization of Supreme Audit Institutions, visit Poland as part of the initiated procedure.

Due to the situation in Poland, the SIRAM procedure (Supreme Audit Institutions Independence Rapid Advocacy Mechanism) was launched. It is a procedure that is implemented when the independence of the highest audit institutions, such as Poland, is threatened Supreme Chamber of Control.

The President of the Supreme Chamber of Control submitted an application to launch the procedure Marian Banaś, and the decision to initiate it was made by EUROSAI (European Organization of Supreme Audit Institutions) and INTOSAI (International Organization of Supreme Audit Institutions). Both of these organizations associate NIK counterparts in other countries. The decision to launch the procedure was made after analyzing, inter alia, the Act on the Supreme Audit Office and the Constitution, as well as the national regulations and the situation of the Supreme Chamber of Control and its president.

SIRAM is a four-step process developed by the INTOSAI Development Initiative (IDI). It involves identifying threats to the independence of SAIs (i.e. supreme audit institutions) and their heads, advising and supporting, as well as informing and sensitizing domestic and external stakeholders, and then engaging them in a real way to eliminate existing threats. Previously, this mechanism was applied under EUROSAI to similar institutions in Cyprus and North Macedonia.

According to unofficial information from tvn24.pl from a source in the Supreme Audit Office, IDI sent letters asking for explanations to the president, the marshals of the Sejm and Senate, the minister of justice, the minister of interior and administration, the Public Prosecutor General, as well as senators and deputies. Only the Marshal of the Senate replied Tomasz Grodzki.

Grodzki was to write – as we inform unofficially – that he knows the case of “attacks” on the independence of the Supreme Audit Office and its president and on free courts, prosecutors, the opposition and Senate. Due to the procedure – according to unofficial information from a source in the Supreme Audit Office – representatives of INTOSAI came to Poland on Thursday. The plan includes a visit to the Supreme Chamber of Control (NIK). They are to confirm, inter alia, that their letters reached the above-mentioned persons and to check whether there is a willingness to dialogue and cooperation on the part of the executive authority.

The next step in the proceedings is a report on the situation of threats to the independence of the Supreme Audit Office and hindering the functioning of the Supreme Audit Office – it will be published and presented to the international community. It will arise irrespective of whether the people to whom the letters were addressed with a request for explanations responded to them or not.

After the publication of the report, the Contact Committee of the Presidents of the Supreme Audit Institutions of the European Union and the European Court of Auditors will draft a resolution on the situation of the Supreme Audit Office, and the INTOSAI community, which brings together almost 200 Supreme Audit Institutions from around the world, will meet in November this year and will deal with the case of the Supreme Audit Office.

What does INTOSAI do?

INTOSAI promotes the preservation and protection of the principle of the independence of supreme audit institutions as laid down in the 1977 Lima Declaration.

At that time, eight pillars were distinguished, which are the key conditions for the control of public finances: inviolable legal status, independence of financial resources, independence of human resources, freedom of action and selection of audit topics, freedom of access to information during an audit, possibility of reporting on audit activity, inviolable content and deadlines for audit documents; and effective mechanisms for monitoring recommendations and conclusions.
