Trade unionists from Rafako, President of Racibórz and staroste Racibórz signed a letter to Prime Minister Donald Tusk to accelerate the procedures to be aimed at saving in the bankruptcy of the plant. The group layoffs of all employees began in it, which will last until the end of February 2025.
The Ministry of Industry, asked for a comment, signaled that a meeting with the social side would take place in the near future.

“Dear Prime Minister, we are asking you to intervene, because we see that without her Rafako will cease to exist. (…) We are grateful that finally the interviews of the Industry Development Agency with the trustee announced by the Ministry of State Asset.
“We know that MAP and ARP declared the will to save the plant, but the pace of this process means that currently a trustee who tried to keep jobs has been forced to start group dismissals” – explained.
The chairman of the Independent Self -Governing Trade Union of Rafako employees Marek Langer spoke about the details of the case. As he explained, in the current activities, the main shareholder of Rafako, the PBG company, did not allow the company's unconditional conversion of the company's obligations to shares in an elevated share capital, which would allow it to be saved.
– The conversion was a kind of rescue for the company, for people, but also for shareholders, all shareholders – maybe satisfying would be smaller, but the company would survive – Langer diagnosed. – Today we have only an appeal to the prime minister, because only the prime minister today can make his intervention to speed up work on saving Rafako – the union stressed. He admitted that the maps, according to the declaration, led to the start of talks with the ARP, but the passage of time meant that it was necessary to start dismissal – employees were already awarded to the end of February. – The end of February means the end of work in this plant for us. But I hope it won't. It is not too late yet, this plant can be saved – Langer expressed hope. He emphasized that Rafako with a new owner can become a key link in energy transformation in Poland. “We have lists of intent with all companies that are to make nuclear energy,” he signaled.
President Racibórz Jacek Wojciechowicz explained that he signed a letter because he could not imagine that the know-how, the achievements and crew of Rafako will be wasted in some way. – I believe that the agency of the Prime Minister Donald Tusk And not only will make (…) decisions will be made that will save Rafako for Racibórz and all over Poland – he said.
The staroste of the Racibórz poviat Grzegorz Swoboda added that Rafako is primarily people with huge competences. – The competences of this plant will leave with these people. Let's not let it. (…) It will be a huge loss that will not be eliminated for years – he warned.

As written in the Rafako current report at the time, the decision on the exemption is caused by the Company's bad economic situation, the court issuing a decision on bankruptcy, the need to liquidate the workplace, including the liquidation of workplaces, and the lack of other possibilities of conducting business by the Company or the use of its resources .
Bankruptcy of the company
The District Court in Gliwice issued a decision on the bankruptcy of Rafako on December 19, 2024 (it became final on January 21). A trustee was appointed then, which was Wojciech Zymek.
The Management Board of Rafako filed for bankruptcy on September 26, 2024, indicating the inability to agree with the key creditors of detailed conversions of the Company's obligations to shares in an increased share capital or an alternative scenario for further restructuring of the company's obligations that would reduce debt. According to Rafako, it could allow the company to regain the ability to obtain external financing for future orders.
Rafako is a joint -stock company listed on the WSE. Most of the shares belong – according to the management board – to the bondholders of the bankrupt PBG company. He is a contractor for energy blocks and a manufacturer of energy equipment. The company is one of the largest employers in the Racibórz region.
On December 6, 2024, “Parkiet” published the article “Rafako will be saved. We know the government's emergency plan” suggesting that the government can take into account the controlled bankruptcy of Rafako with an indication of the investor that the Industrial Development Agency could be with another entity – on a similar rule, on a similar rule, which was applied to Huta Częstochowa. In September 2024, the management of Rafako explained that the loss of financial liquidity and the need to submit a declaration of bankruptcy led to the termination by JSW Koks Mediation conducted from Rafako before the General Prosecutor's Office and collect from the warranty deposit PLN 20 million together with the payment of PLN 35 million of warranty. The JSW Koks agreement with Rafako concerned the construction of a cogeneration power block fired with coke gas with a capacity of approx. 32 MW of electric and 37 MW heat. JSW Koks explained its actions by a significant exceeding by Rafako dates and costs of the contract.
