Miłoszyce crime

On New Year’s Eve with December 31, 1996 to January 1, 1997 Fifteen-year-old Małgorzata was having fun with her friends at a disco in Miłoszyce near Wrocław. At one point she walked out in front of the building. Several hours later – on a private property opposite the disco – she was found dead. She died as a result of hypothermia and her wounds. She was brutally raped.

The accusation of Tomasz Komenda

The main evidence against him was the DNA code from the hair and the scent trace found on the hat the perpetrator left at the crime scene, teeth imprinted on the victim’s body and the testimony of Komenda’s neighbor.

During the trial, Tomasz Komenda never pleaded guilty. Once, during a police interrogation, he admitted that on the day of the crime he was where Małgosia was murdered and had intercourse with a strange girl. Then he said that these words were forced by the policemen who beat him.

In 2004, the court sentenced him to 25 years’ imprisonment for the murder and rape of a 15-year-old girl. In 2005 Supreme Court dismissed the cassation appeal against the judgment.

The man was serving a sentence in the Prison in Strzelin.

Getting out of prison

In 2016, prosecutors returned to the case the so-called Miłoszyce crime. During the re-analysis of the case, it turned out that Tomasz Komenda may be innocent.

On March 15, 2018, Komenda was released from prison conditionally after spending 18 years behind bars. Two months later, the Supreme Court acquitted him. Tomasz Komenda was 41 years old when he was acquitted of all charges. He spent 6,540 days in prison.

Award of compensation

In 2021, the court awarded the Command a total of over PLN 12.8 million in compensation and damages.

At the end of December 2023, the District Prosecutor’s Office in Łódź issued a decision to discontinue the proceedings, in which she spent almost six years explaining who was behind the wrongful arrest and conviction of Tomasz Komenda.
