Torun. Katarzyna P., co-creator of Amber Gold, will not be released early. Court decision

Katarzyna P., co-founder of Amber Gold, applied for conditional release from the rest of the sentence. On Thursday, the District Court in Toruń (Kuyavian-Pomeranian Voivodeship) made a decision in this case and refused P. to go free. The decision is not final.

Katarzyna P. was arrested in April 2013. In October 2021 the court released her arrest and applied libertarian preventive measures against her. She had previously given birth to a child in prison. The woman was under police supervision (she had to report to the police station three times a week and was not allowed to leave her place of residence), she was not allowed to contact her co-defendant and witnesses, she was forbidden to leave the country, she was also deprived of her passport.

Final judgment on the creators of Amber Gold was passed at the end of May 2022 in the Court of Appeal in Gdańsk. The court then upheld part of the lower court’s judgment. Marcin P. was sentenced to 15 years in prison, and Katarzyna P. was sentenced to 11.5 years in prison.

Last July, Katarzyna P. volunteered to do the rest – 2.5 years – imprisonment.

The court refused to grant Katarzyna P. conditional release. Invalid decision

On Thursday, at a session, the District Court in Toruń considered the application of the former vice-president of Amber Gold for conditional early release from serving a sentence. Katarzyna P. tried to be released because she had already served three quarters of her sentence.

– The District Court in Toruń, by decision of February 9, 2023, refused to grant Katarzyna P. conditional release from the execution of the rest of the sentence of imprisonment. The decision is not final – informed Justyna Kujaczyńska-Gajdamowicz, spokesperson of the District Court in Toruń.

Marcin P. and his wife Katarzyna P. in 2009-2012 as part of the so-called financial pyramid defrauded a total of over 18,000. customers of the company, leading them to unfavorable disposal of assets in the amount of almost PLN 851 million. The accusation also concerned conducting quasi-banking activities and money laundering. According to the prosecutor’s office, Katarzyna P. and Marcin P. acted in order to achieve financial gain and made this activity a permanent source of income.

Amber Gold is a company that was supposed to invest in gold and other metals. It has been operating since 2009, and tempted customers with a high interest rate on investments – from 6 percent. up to 16.5 percent. per annum – which significantly exceeded the interest rate on bank deposits. On August 13, 2012, the company announced liquidation, and did not pay thousands of customers the money entrusted to it or interest on them.

Katarzyna P. and Marcin P. spent the money obtained from deposits for various purposes – e.g. Almost PLN 300 million was allocated to finance the OLT Express airline (a carrier that no longer exists, in which Amber Gold was the main investor). Part of the income also went to salaries. It was established that the defendants paid themselves PLN 18.8 million on this account.
