Turów Mine, Disciplinary Chamber. Penalties – The European Commission deducted penalties from EU funds for Poland

The Court of Justice of the European Union (CJEU) imposed daily penalties on Poland in two cases: for the operation of the Turów mine and for the operation of the Disciplinary Chamber of the Supreme Court. According to information from the TVN24 correspondent, Maciej Sokołowski, the European Commission has already deducted all penalties for Turów, while in the case of the Disciplinary Chamber, the penalties are successively reduced by the Commission from funds for Poland.

The penalties relate to two cases – in the first one it was related to the Polish-Czech one dispute over the Turów mine. Penalties of half a million euros a day were applied from September 20, 2021 to February 3, 2022. The counter stopped running after Polish-Czech agreement on the Turów mine.

As the TVN24 correspondent in Brussels, Maciej Sokołowski found out, in The European Commissionthe last penalty was deducted on May 31 and the matter ends there, so all due penalties have already been deducted from the funds for Poland.

This means that although the Polish government has announced that it will not pay fines for Turów, Poland has already given back all due EUR 68.5 million (over PLN 300 million).

Penalties in the case of the Disciplinary Chamber

The second case concerns the penalty for the functioning of the Disciplinary Chamber of the Supreme Court. Court of Justice of the European Union in the summer of 2021, he obliged Poland to immediately suspend the application of the provisions relating to the powers of the Disciplinary Chamber The Supreme Court in matters of, inter alia, lifting the immunities of judges. For failure to comply with this decision, the CJEU fined Poland one million euro a day.

Penalties are calculated from November 3. On June 9, it is 219 days, which equates to EUR 219 million – calculates Maciej Sokołowski.

So far, the Commission has issued payment notices for a total amount of EUR 174 million, of which EUR 111 million has already been deducted from funds for Poland.

On Thursday, the Seym rejected 23 of the 29 Senate’s amendments to amendment to the law on the Supreme Court. Not all the key amendments regarding, among others, annul the decisions of the Disciplinary Chamber being liquidated. The main premise initiated by the president Andrzej Duda of the amendment is the liquidation of the Disciplinary Chamber and the establishment of the Professional Responsibility Chamber in its place.
