The liquidator of TVP SA, Daniel Gorgosz, once again called on the chairman of the National Broadcasting Council, Maciej Świrski, to transfer the revenues from license fees to the company. Gorgosz also issued a pre-trial demand for payment. The amount is nearly PLN 38.8 million.
TVP reported that on Monday, Daniel Gorgosz, liquidator of Telewizja Polska SA in liquidation, called on Maciej Świrski, chairman of the National Broadcasting Council, to pay PLN 38,760,000 as revenue from license fees within 7 days from the date of delivery of the request. The announcement was accompanied by a pre-trial demand for payment in this case.
As indicated, the money “should be transferred to TVP SA in liquidation on January 11 and 22, 2024 in accordance with the schedule provided to the Company by the Chairman of the National Broadcasting Council.” “Daniel Gorgosz, Liquidator of Telewizja Polska SA in liquidation, informed in the summons that in the event of failure to pay the above amount within the specified deadline, the case will be referred to court proceedings,” the statement added.
The war for the TV license fee
This is another letter on this matter. Liquidator of TVP SA January 24 this year called on the chairman of the National Broadcasting Council “to immediately” transfer the revenues from license fees to the company. Daniel Gorgosz announced then that “the company intends to take further legal steps to protect its interests and enforce payment of outstanding subscription funds.”
The head of the National Broadcasting Council, Maciej Świrski, responded to this letter. He informed that the transfer of funds from license fees is impossible because “there is no company Telewizja Polska SA in liquidation”. Thus, the National Broadcasting Council maintained its position on putting TVP into liquidation, which is considered inconsistent with applicable regulations.
The liquidator of TVP SA then filed notification to the Prosecutor General on suspicion of committing a crime by members of the National Broadcasting Council. This was related to the resolution of the National Broadcasting Council on the postponement of the payment of funds from media subscription revenues.
National Broadcasting Council on January 10 this year. adopted a resolution to postpone the payment of funds from media license fees to February 12 this year. The Council indicated that the decision was related to “the legal chaos arising in public radio and television broadcasting units caused by the decisions of the Minister of Culture and National Heritage.”
In the opinion of TVP, “the National Broadcasting Council unjustifiably made the mechanism for the payment of funds from license fee revenues to public radio and television broadcasting entities put into liquidation conditional on confirmation of the liquidation status by a final judgment of the registry court.” Telewizja Polska emphasized that “the funds from license fee revenues were not transferred, despite previous efforts.”
