TVP’s liquidator is demanding nearly PLN 39 million. Daniel Gorgosz sent a letter to the chairman of the National Broadcasting Council, Maciej Świrski

The liquidator of TVP SA called on the chairman of the National Broadcasting Council, Maciej Świrski, “to immediately” transfer the revenues from license fees to the company. The amount is nearly PLN 38.8 million.

Telewizja Polska reported that on Wednesday, Daniel Gorgosz, the liquidator of Telewizja Polska SA in liquidation, sent a letter in which he called on the chairman of the National Broadcasting Council, Maciej Świrski “to immediately transfer the revenues from license fees due to Telewizja Polska SA in the liquidation in the total amount of PLN 38,760,000.” As indicated, the measures “should be implemented on January 11 and 22, 2024, in accordance with the schedule provided to the company by the Chairman in the letter of October 23, 2023.”

TVP liquidator on the resolution of the National Broadcasting Council

National Broadcasting Council on January 10 this year. adopted a resolution to postpone the payment of funds from media license fees to February 12 this year. The Council indicated that the decision was related to “the legal chaos arising in public radio and television broadcasting units caused by the decisions of the Minister of Culture and National Heritage.”

In the opinion of the liquidator of Telewizja Polska SA, the resolution of the Council “was adopted in gross violation of the law, both in terms of the legal bases and motives set out therein, and is therefore contrary to Article 7 of the Constitution of the Republic of Poland.” This article of the constitution states that “public authorities act on the basis and within the limits of the law.”

“(…) The National Broadcasting Council is not authorized to examine the legality of the minister’s actions, and the assessment in this respect is included in the resolution in question,” wrote Gorgosz in a letter addressed to the chairman of the National Broadcasting Council.

As we read, “the company is of the opinion that the arbitrary and unexpected suspension of the payment of funds that are due to the company and necessary for the current implementation of its public mission violates the principle of protecting trust in state authorities (Article 2 of the Constitution of the Republic of Poland) and is contrary to the public interest in radio broadcasting. and television, the guardian of which was the National Broadcasting Council (Article 213(1) of the Constitution of the Republic of Poland).

The liquidator of Telewizja Polska SA in liquidation announced that “the company intends to take further legal steps to protect its interests and enforce payment of outstanding subscription funds.”
