Cohen pleaded guilty to the theft

Cohen previously told the court that in 2016 he made the payment at Trump's direction, and that Trump then repaid him the amount, making 34 smaller transfers and counting it as “legal costs.” Trump was charged with 34 counts of falsifying business records in this case.

During his testimony, Cohen also admitted to stealing $30,000 from the Trump Organization years ago. He explained that the theft occurred after Cohen hired the technology company Red Finch to help increase the number of Trump supporters in an online poll.

Cohen testified that Trump was “upset” at the time to be at the bottom survey. By hiring Red Finch, Cohen explained that he and Trump could have manipulated the poll they ordered so that the tech company could cast false votes on Trump's behalf using different IP addresses.

Cohen explained that Red Finch was originally supposed to receive $50,000 for his services. But he said he instead paid the company only $20,000 and took the rest for himself after Trump decided to cut his bonus. “I was angry about the bonus being cut, so I felt like it was just self-help,” Cohen said.

The defense attorney says the testimony is unreliable, the prosecutor says otherwise

On Monday, Donald Trump's lawyers asked the judge overseeing the criminal trial to throw out the case before it reaches a jury. Lawyers argued that Michael Cohen's testimony about his lies and thefts was unreliable.

Judge Juan Merchan, presiding over Trump's criminal trial, did not agree to the request of the former president's defense lawyers. He said experienced jurors would be able to judge for themselves the credibility of Cohen's testimony. – You say his lies are undeniable, but do you think he will be able to deceive 12 New Yorkers? – the judge asked Todd Blanche, Trump's lawyer.

Prosecutor Christopher Conroy, in turn, emphasized that Cohen's testimony was supported by documents and other evidence. – The evidence from the trial overwhelmingly confirms every element of the crime – he explained.

Cohen convicted of lying and violating electoral law

Michael Cohen was Trump's personal lawyer and adviser and is now a vocal critic. His 2020 memoir, Disloyal, was a New York Times bestseller.

In December 2018, Cohen was sentenced to three years in prison for, among other things, paying for the silence of women who allegedly had affairs with Trump during the election campaign and submitting false testimony to the US Congress. Cohen, who faced five years in prison, was convicted of violating election law because he paid for the silence of two women.

He was also sentenced to two months in prison for lying to Congress about Trump's planned investment in building a hotel in Moscow.

Prosecutors accuse Trump of illegally trying to disguise these expenses as payment for legal services to his then-lawyer Michael Cohen, who brokered the deal.

This carries a penalty of up to 20 years in prison, although most experts do not expect a prison sentence if the former president is convicted. Cohen himself was convicted of, among others, in this case in 2018 and spent three years in prison.
