All suspicions and allegations regarding the visa scandal concern the management of the Ministry of Foreign Affairs, said Deputy Minister of Foreign Affairs Andrzej Szejna in “Fakty po Faktach”. Former deputy head of the Ministry of Foreign Affairs in the PiS government, Arkadiusz Mularczyk, expressed his belief that the entire management of the ministry at that time notified the relevant law enforcement authorities when they received information about any irregularities.

On Monday, the hearing of former Deputy Minister of Foreign Affairs Piotr Wawrzyk took place before the parliamentary commission of inquiry into the visa scandal. It only lasted about 20 minutes. It started with a request from his representative to exclude the committee chairman from the meeting. After the vote, the proposal was lost. After answering the first question, Wawrzyk exercised his right to refuse to testify.

Szejna emphasized that he was speaking on behalf of the Ministry of Foreign Affairs. – Consular matters are supervised by the minister, an outstanding diplomat (Henryka – ed.) Mościcka-Dendys, and I gain knowledge, of course, from her, from the chairman (of the investigative committee Michał – ed.) Szczerba, but also, of course, above all, from the ministry that I co-head – he pointed out.

– There is no doubt that the suspicion of committing a crime is justified. First of all, I would like to make it clear that from our point of view, I am talking about the Ministry of Foreign Affairs, the consuls were not involved in any criminal activities. And I want it to be heard here and now, he said.

– However, all suspicions and allegations concern the management of the Ministry of Foreign Affairs – he added. As he said, “the accusation brought against the management of the Ministry of Foreign Affairs is such (…) that it is not an accusation of action, but of omission.” – So there was knowledge among many members of the management and we have this information, but they did not take action to stop this practice – he emphasized.

– This is, of course, Article 231 of the Penal Code. And this is a huge responsibility, he added.

§ 1. A public official who, exceeding his or her powers or failing to fulfill his or her duties, acts to the detriment of the public or private interest shall be subject to the penalty of imprisonment for up to 3 years. § 2. If the perpetrator commits the act specified in § 1 in order to obtain a financial gain or personal data, is subject to the penalty of imprisonment from one year to 10 years. § 3. If the perpetrator of the act specified in § 1 acts unintentionally and causes significant damage, he or she shall be subject to a fine, restriction of liberty or imprisonment for up to 2 years. § 4. The provisions of § 2 shall not apply. if the act meets the criteria of a prohibited act specified in Art. 228.

Mularczyk: as long as the investigation is ongoing, this is Piotr Wawrzyk’s strategy

Arkadiusz Mularczyk said that “an investigation is underway by the prosecutor’s office in this case.” – Piotr Wawrzyk is probably a suspect in these proceedings. Of course, he is presumed innocent until he is convicted by a court, but he has a special status in these proceedings. Everything he could potentially say in these proceedings could have an impact on the ongoing investigation, he said.

– I don’t want to evaluate the adopted strategy or tactics here, after all, he also uses the help of a patron. We must be aware that, apart from the proceedings before the investigative commission, which has its own rigor, it is, in a sense, political theater, but on the other hand, there is an ongoing investigation that is not theater – he said.

– This is a proceeding aimed at determining whether and who committed a crime related to visa trading, or whether it was a crime at all. As long as this investigation is ongoing, this is the strategy adopted by Mr. Piotr Wawrzyk – he added.
