The tram driver, who, according to the prosecutor’s office, is guilty of the fatal accident in Praga, will soon sit in the dock. There is already an indictment in court regarding the tragedy on Jagiellońska Street. The door of the tram caught the four-year-old, the train started moving, the boy could not be saved.

– On June 28, the Warsaw Praga-Północ District Prosecutor’s Office filed an indictment against Robert S., a tram driver in Warsaw – Katarzyna Skrzeczkowska, spokeswoman for the Warsaw-Praga District Prosecutor’s Office, told us.

It’s about a tragic accident that happened in mid-August last year, on Jagiellońska Street, at the Batalion Platerówka stop. An old-type tram, going towards the Żerań FSO terminus, participated in it. A four-year-old child was trapped in the door, the tram dragged the boy along the track. The four-year-old could not be saved.

He was using his phone while driving

– In the indictment addressed to the Warsaw District Court Praga-Północ, the tram driver is accused of intentionally violating the safety rules in land traffic and the provisions of the instructions for employees of Warsaw Trams, and unintentionally causing an accident that resulted in the death of a four-year-old boy – reminded prosecutor Skrzeczkowska. The man is facing eight years in prison.

As the spokeswoman added, the evidence in the case that proves the fault of the tram driver is: the opinion of an expert in the field of railways, analysis of monitoring recordings, lists of telephone calls and a report of events taking place in the accused’s phone, as well as testimonies of witnesses heard in the case.

– The evidence shows that the accused, driving the tram, used the telephone and headphones while driving, incorrectly observed the events taking place within the last door of the train, through which the child got off, and after closing this door, he did not make sure that starting from the stop would not pose a threat for passengers getting off and at the bus stop, said the representative of the prosecutor’s office.

1.5 seconds to assess the situation

According to the investigators, “the driver spent less than 1.5 seconds assessing the situation around the tram”.

– This time was found by the expert appointed in this case to be insufficient for a correct assessment of the situation. It should be emphasized that the structure of the car and the last door did not impede the driver’s visibility, the tram was technically efficient, and the victim and the person under whose care he was staying did not contribute to the accident, the spokeswoman said.

And she reminded that, according to the instructions for employees of Tramwaje Warszawskie, tram drivers are forbidden to use mobile phones while driving, including the use of headphones and hands-free kits. – In addition, the tram driver may move from the stop after making sure that all doors are completely closed and that moving will not pose a threat to passengers at the stop – said Katarzyna Skrzeczkowska.

Robert S. pleaded not guilty and refused to provide explanations in this case.
