A verdict has been passed in the case of a double murder in Warsaw's Białołęka district. Jarosław K. was sentenced to life in prison for killing his 50-year-old sister and her 22-year-old son. In his justification for the sentence, the judge emphasized that he had never encountered such a brutal crime in his over 30-year career. Unjustified, not at fault. K. will be able to apply for early release after 45 years. The judgment is invalid.

The court mainly took into account the exceptional brutality of the crime and had no doubts about the punishment imposed. After hearing the case, he found Jarosław K. guilty of murder: his 50-year-old sister Anna and her 22-year-old son Wiktor. For both crimes, the defendant was sentenced to a total life sentence. He will be eligible for early conditional release only after 45 years. This means that if the verdict becomes final, K., now 39, will be released from prison at the earliest when he is in his eighties.

The murder took place on February 28, 2023 in Białołęka, in the family home of Mr. and Mrs. K. Anna and her two brothers (including Jarosław) inherited it from their parents.

The case files show that Wiktor died first, around noon. According to the court, his uncle struck him numerous times in the head with a blunt instrument. The 22-year-old died as a result of his injuries. On the same day, in the afternoon, Jarosław K. also attacked his sister. He hit her on the head with an axe. The seriously injured 50-year-old died. – In the case of his nephew Wiktor, the accused also used a knife, causing additional injuries to his face, hands and larynx. These were blows penetrating deep into the soft tissues – revealed judge Sławomir Bielecki.

The accused did not plead guilty to the charges against him and did not explain anything. In court, he always said that he would “answer, but later.” However, he did not say anything significant until the end of the trial, apart from the sentence at the very end of the trial that he was “very sorry that he had to expose his brother to such unpleasantness.”

An unjustified crime, without a reason

All witnesses interviewed in the case explained that K. was a withdrawn and quiet person. He had no criminal record and had no conflicts with the law. – But he was also a strange person. In fact, he avoided the company of both his family and other people. He also had a part-time job, on a contract basis, and later as a security officer in a store, said Judge Bielecki.

The court emphasized that opinions in K.'s case were issued by two teams of experts because – as it stated – they wanted to check whether the accused was sane. – It's rare to have a situation like this, a case in which a person is accused of two murders, and such brutal ones. I can say this with full responsibility: to such an extent unjustified and without reason – said Judge Bielecki in the justification of the judgment.

It was established that there could be two reasons for the crime. The first was that K. had not been contributing to the maintenance of the rather large house in which he lived with his sister Anna and her son Wiktor for a long time. – In fact, only Mrs. Anna, who had a son to support and herself at the same time, tried to ensure that her brother participated in the maintenance of the house – said the judge.

22-year-old Wiktor finished school, worked and started studies. In his case – according to experts – it could have been about jealousy. Jarosław did not manage to achieve what his nephew did. Because he had a permanent job and functioned normally in society. K didn't have it. Experts mentioned his features as: emotional deficit and lack of empathy. But the court emphasized that he had not been diagnosed with any mental illness or damage to the central nervous system.

The judge also recalled that after the murders, K. went shopping, bought alcohol, came back and drank.

– This proves that it was planned by him and consistently implemented. Although brutal in a way that is rarely seen. Even I, in over 30 years of judging criminal cases, have encountered such brutality for the first time. I have passed sentences in dozens, if not more, murders. But I have never encountered one so brutal. Even more so (…) in relation to his closest relatives, with whom he actually had no conflict – judge Bielecki said.

After committing the crime, K. tried to commit suicide. Police photos after his arrest show bandages on his forearms. However, experts found that it was more of a show-off than an actual desire to kill himself. The judge explained that this was assessed as the defendant's defense. Including amnesia, because K. hid himself from remembering what happened. – The accused is an intelligent person, with shortcomings and an incorrect personality – said the court.

During the case, it also came to light that K. was abusing alcohol. This caused him to lose himself in various situations. Witnesses testified that he once hired women from an escort agency and stayed with them for a long time in a hotel, where at the end he trashed the room.

The court found only one mitigating circumstance: the defendant's clean criminal record. – But this circumstance, compared to these allegations, is not of marginal importance – said the court.

The court also imposed a punitive measure against the accused in the form of deprivation of public rights for a period of 10 years. In addition, he will also have to pay a total of PLN 220,000 in compensation to the victims' relatives. He will also bear legal costs.

Anna's partner and Wiktor's biological father were present at the reading of the verdict. We asked whether they believed the verdict was fair. – Yes, that's what we fought for. If there is no death penalty, we wanted him to get a life sentence. This is what we requested. No one will bring our loved ones back to life, but if such a verdict has been passed, we are satisfied – they replied.

Let us recall: at the end of February 2023, a police patrol in Białołęka received information from concerned residents of Nowodworska Street about the lack of contact with their neighbor living in the house next door. The officers decided to check the indicated address. Nobody answered the door. There were no sounds from inside either. After contacting the police station officer on duty, a decision was made to forcefully enter the house with the help of firefighters. Inside bodies found, and in the living room there was an injured man sitting in an armchair showing signs of life. After providing help, the 37-year-old was taken to hospital for tests, escorted by police officers.

A few days later, the Warsaw Praga-Północ District Prosecutor's Office charged Jarosław K. with double murder, and the man was taken into custody.
