The prosecutor's office sent an indictment to the court regarding the accident that occurred in 2024 at Puławska Street in Warsaw. Gennady A. and Michał C. were accused of inadvertently causing a disaster in land traffic. The second of them, additionally, for driving under the influence of drugs. They did not confess to the alleged acts.

The accident occurred June 9, 2024 in Warsaw at the intersection of Puławska and Malczewskiego Streets. Toyota and BMW collided, the last one entered a group of passers -by, and then roofed.

As a result of this accident, one person suffered injuries constituting severe damage to health in the form of a real -life -threatening disease, three people suffered medium injuries, one lightweight and one person suffered general bruises.

One accused of causing a disaster

As described by the spokesman of the District Prosecutor's Office in Warsaw, prosecutor Piotr Antoni Skiba, a man “by performing a left turning maneuver from Puławska Street in Malczewskiego did not exercise special caution and did not give way to the priority of the BMW vehicle on the right side of Puławska Street when broadcasting a green signal and moving at a speed of not less than 86.4 km/h. 114.08 km/h significantly exceeding the administrative speed of 50 km/h on this section of the road, which inadvertently violated the principles of safety in land traffic set out in Art.

An accident at Puławska

The result was a collision with a BMW car driven by Michał C. and inadvertently causing an accident, as a result of which BMW twice turned around its axis, then passing in a place where six pedestrians waited before switching to the green light.

Gennadi A. is punishable by imprisonment from 6 months to 8 years.

The second was under the influence of drugs

The second of the accused is a Polish citizen Michał C. “He was accused of driving a BMW vehicle and moving the middle lane of Puławska Street road traffic, under the influence of a intoxicant in the form of cocaine in a concentration of 15 ng/ml in the blood, as well as its active metabolite in the form of a cocaietlene at a concentration of 8 ng/ml in the blood, inadvertently brought a disaster in life -threatening life. and the health of many people, in such a way that, intentionally violating the rules of safety in land traffic, he used an incorrect driving technique, moving at a speed of not less than 86.4 km/Hi no more than 114.08 km/h significantly exceeding the administrative speed of 50 km/h on this section of the road, not being controlled by the vehicle and not including the conditions in which it took Movement ” – described prosecutor Skiba.

According to the prosecutor's office, the BMW driver led to an incorrect assessment of the situation in the area of ​​the intersection of Puławska and Malczewskiego Street by the Toyota Prius driver, which did not give way to BMW's priority while performing a left turn maneuver from Puławska Street in Malczewskiego and collided with Toyota.

Michał C. was also accused of intentional violation of land traffic safety rules. “Being under the influence of a narcotic drug in the form of cocaine in a concentration of 15 ng/ml in the blood, as well as its active metabolite in the form of cocaietlene in a concentration of 8 ng/ml in the blood in the blood, he managed a public motor vehicle along the public road, i.e. a crime from Article 178a Paragraph 1 of the Penal Code” – Prosecutor Skiba said.

Michał C. is punishable by imprisonment from 3 years to 16, for driving a vehicle under the influence of drugs there is a penalty of imprisonment up to 3 years old, a ban on driving and a cash benefit.

They did not admit

According to the prosecutor's office, Gennadi A. has been examined twice. The result came out negative, nor was it under the influence of drugs – said the prosecutor. Initially, the man confessed to committing the alleged act and explained, but at the next interrogation, after presenting him the allegations he changed his mind and refused to explain – the prosecutor's office said.

He added that Michał C interrogated as a suspect did not confess to committing the alleged acts and refused to explain. “In the course of the next interrogation, after the announcement of the decision to amend the decision on the presentation of the allegations, he did not confess to committing the alleged acts and gave explanations, responding to the second of the allegations announced” – he clarified.

The accident could be avoided

According to the findings of the prosecutor's office, Gennada A. during the turning maneuver from Puławska Street to the left in Malczewskiego did not exercise particular caution and did not give way to the BMW driver. “The behavior of Toyota Prius Gennadi A. was incorrect and was a direct cause of the accident” – emphasized the prosecutor.

“On the other hand, in relation to the accused Michał C. the expert pointed out that the driving technique he used was incorrect. If the driver of the BMW car was moving at an administrative speed, the vehicle would stop in front of the pedestrian deduction, and thus the effects in the form of pedestrian deduction result from the incorrect technique and tactics adopted by the driver.” Skiba.
