The police have still not completed disciplinary proceedings against two officers who crashed a police car on a tree in Dawidy Bankowe at the beginning of January. Two teenagers were with them, one was injured.

“It’s been 3 months since 2 police officers took the teenagers to the forest in a police car (and crashed the police car) – according to the response of the National Police Headquarters, the disciplinary proceedings have not been completed, they are still ongoing,” Krzysztof Brejza, Senator of the Civic Coalition, announced on Tuesday via social media.

In a letter dated March 27, the Deputy Chief Inspector of the Police, Superintendent Roman Kuster, informed the Senator that the disciplinary proceedings initiated against the police officers who transported two teenagers in a police car, and one of them led to an accident, “remained pending”. He also said that regardless of these proceedings, the District Prosecutor’s Office in Warsaw is conducting its investigation.

Let’s remind: the incident took place in early January near Warsaw near the intersection of Kinetyczna and Złote Łany streets in Dawidy Bankowe. A report of grass burning has been received by the authorities. Police officers found firefighters and a group of young people on the spot (later they assured that they were the ones who called about the fire). After the intervention, the police transported a 17-year-old and a 19-year-old in a police car. They crashed the car into a tree.

According to the girls’ account, they told them to run away. They did not call for help, although the passengers were injured. The police confirmed that they “obtained medical assistance on their own”. The younger one had a serious nose injury, she underwent surgery a few days after the incident.

The spokesman for the Warsaw police, Sylwester Marczak, later said that there were no grounds for “these people to be in this police car”. Hence the decision to initiate disciplinary action against the police officers.

Disciplinary charges against officers

MPs from the Civic Coalition, Kinga Gajewska and Aleksandra Gajewska, also took up the case of the policemenwho carried out a parliamentary inspection at the headquarters. Their findings show that one of the policemen, the one who was driving the car, has 18 years of service. The second policeman, who was a passenger, is on a basic course. He worked for two months. It was his first patrol and first intervention.

The deputies reported that the senior police officer received six disciplinary charges, while the younger one – four. The senior officer was suspended. The MPs asked about the content of these allegations and why only one of the policemen was suspended. The police did not answer.

The investigation by the prosecutor’s office is still being conducted in the case of an act under Article 177 paragraph 1 in conjunction with Article 162 paragraph 1 in conjunction with Article 11 paragraph 2 of the Criminal Code. These rules apply to causing an accident unintentionally and failing to provide assistance to the injured.

Art. 177. § 1. Whoever, violating, even unintentionally, the rules of safety in land, water or air traffic, unintentionally causes an accident in which another person suffered bodily injuries specified in Article. 157 § 1, is subject to the penalty of deprivation of liberty for up to 3 years. Art. 162 § 1. Whoever is in a situation threatening the immediate danger of loss of life or serious damage to health does not provide assistance, being able to provide it without exposing himself or another person to the danger of loss of life. life or grievous bodily harm, shall be punishable by imprisonment of up to 3 years. Art. 11§ 2. If the act meets the characteristics specified in two or more provisions of the criminal act, the court shall sentence for one offense on the basis of all concurrent provisions.

Hearings are ongoing, and so far no one has been charged.
