The final judgment was issued after an eight-year court battle

After eight years, a final judgment was passed in the case of the famous singer Dorota R., her ex-husband Emil S. and four men accused of intimidating and blackmailing the artist's former partner, Emil H., in December 2016.

An invalid decision in this case was made in March 2024 in the Warsaw-Mokotów District Court. The court then sentenced the artist to one year in prison, suspended for two years, and PLN 100,000. PLN fine. In turn, Emil S. received nine months of absolute prison, a year and a half of community service and PLN 100,000. PLN fines, and the remaining defendants received suspended sentences.

The defenders and the subsidiary prosecutor appealed against this decision. On Wednesday, the District Court in Warsaw issued a final judgment in this case.

Changes to the first judgment. There is no absolute prison sentence, a lower fine

The court commuted Emil S.'s sentence and imposed a penalty of four months' imprisonment, one year and four months of restriction of liberty consisting in performing unpaid, supervised work for social purposes for 40 hours a month.

In addition, the court overturned the contested judgment in relation to one of the accused men and referred his case for retrial. He also changed the descriptions and classification of the acts attributed to the accused.

He also ordered the singer and Emil S. to pay PLN 20,000. PLN damages to the injured party, and damages from other defendants from PLN 5,000 to PLN 10,000. PLN and making the judgment public by posting an extract from the judgment on the BIP website of the District Court for Warsaw-Mokotów for a month.

In the remaining respects, it upheld the judgment.

A judge with unbelievable explanations

In an oral statement lasting over an hour, judge Danuta Grunwald said that Emil S.'s explanations were unbelievable.

– First of all, it is worth mentioning the version that the visits of the “executors” to the injured party were supposed to be legal negotiations. (…) However, this version cannot be considered credible in the opinion of the appellate court, because the case files show that at that time these legal negotiations had already taken place and were conducted by lawyers (…). They ended in failure, the judge noted.

She emphasized that the actions taken by Emil S. are the result of the fact that previous attempts to settle the matter amicably with the injured party, Emil H., had failed.

The judge added that Emil S.'s claims that the artist did not participate in these events are, in the opinion of the appeals court, unreliable.

– A number of circumstances indicate this, because the accused had a motive to act – said the judge.

She recalled that in November 2016, a judgment ordering the return of the engagement ring from Emil H. became final against the singer. At that time, there were also two proceedings under his notice in two criminal cases.

– In one of these cases, the accused was interrogated as a suspect at that time. In the second case, an indictment was submitted to the district court in December and the trial date was set for January. (…) All this happened at the turn of November and December 2016, which indicates that the accused had a motive to act because she did not want to comply with the judgment and did not want to appear before courts in subsequent cases – she said judge.

She added that at that time the artist and Emil S. were in a relationship.

“From the Back Seat”

In her oral justification, she also indicated that the accused is the person who “controls all this from the back seat and was clearly the person who initiated and participated in this process of inciting to commit a crime to the detriment of the subsidiary prosecutor (Emil H. – ed.)”.
