Warsaw. Krzysztof S. famous musician accused. It’s about sexual abuse

Krzysztof S., a jazz musician, will sit on the dock. According to the investigators, he sexually abused a minor at the workshop he was the president of.

The indictment against Krzysztof S. was filed by the prosecutor’s office on July 14, the spokesman for the District Prosecutor’s Office in Warsaw, Szymon Banna, informed. The musician was charged with an act under Art. 200 pairs 1 of the Penal Code, i.e. sexual abuse of a person under the age of 15. The musician faces 12 years in prison.

He did not confess

– The allegation concerns an incident from 2017, which took place in Puławy during jazz workshops organized for children and youth by an association whose president was the accused Krzysztof S. at the time – explained prosecutor Banna.

He added that the suspect had pleaded not guilty to the charges against him and declined to comment on the case.

Notifications submitted in 2018

This is not the only case of Krzysztof S. that was investigated by Warsaw investigators. As we have already reported, at the end of October 2018, the prosecutor’s office received other notifications regarding the musician. It was about sexual crimes that he allegedly committed back in the 90s, however, the proceedings at the end of last year were discontinued due to the statute of limitations.

– In the course of the investigation, it was established that all the acts, except for one, which were testified by the injured persons, were already statute barred when they were notified to the prosecutor’s office. According to the Code of Criminal Procedure, the statute of limitations is a negative procedural premise preventing the continuation of the proceedings. Art. 17 § 1 point 6 of the Code of Criminal Procedure directly indicates that the proceedings are discontinued if the statute of limitations has expired – Szymon Banna has now reminded.

He noted that the statute of limitations for the acts had been confirmed by the District Court for Warszawa Mokotów in Warsaw, which, upholding the prosecutor’s decision to discontinue the investigation, indicated that regardless of what legal classification of the behavior described by the injured parties was adopted, these acts were already statute-barred at the time the notifications were sent to the prosecutor’s office.

The crimes were allegedly committed between 1997 and 1999.
