Warsaw. Musician Krzysztof S. accused of sexual abuse of a minor. The trial starts in January

Krzysztof S., a famous jazz musician, will sit on the bench of the accused in the District Court for Warsaw Praga-Południe. Investigators accuse him of sexually abusing a minor during music workshops. The trial will begin on January 30.

Indictment against Krzysztof S. District Prosecutor’s Office in Warsaw she went to court in July. The co-creator of the music program for children and teenagers “Tęczowy Music Box” was accused of sexual abuse of a person under 15 years of age. For the alleged act, he faces from 2 to 12 years in prison.

The incident allegedly took place during workshops for children

– The charge concerns an event in 2017 that took place in Puławy during jazz workshops organized for children and teenagers by an association whose president at that time was the accused Krzysztof S. – explained the prosecutor.

She added that the suspect did not admit to committing the act he was accused of and refused to provide explanations in the case.

Initially, the case of the famous musician was brought to the District Court in Puławy. Then, however, the District Court in Lublin, under which the District Court in Puławy falls, decided to refer it to the District Court for Warsaw Praga-Południe for consideration.

As PAP found out, the Warsaw court set the first hearing date for January 30.

Report and statement of the prosecutor’s office

After the publication of the film, the District Prosecutor’s Office in Warsaw commented on the case, which in its statement indicated that only one of the several acts accused of the musician was not subject to the statute of limitations, and the proceedings in the man’s case were at the final stage.

Notifications of the victims that Krzysztof S. had committed sexual crimes to their detriment, which allegedly occurred in the 1990s, were received by investigators only at the end of October 2018, the prosecutor’s office said.

– During the investigation, it was found that all the acts, except one, about which the injured persons testified were already time-barred when they were notified to the prosecutor’s office. According to the Code of Criminal Procedure, the statute of limitations is a negative procedural condition that makes it impossible to continue the proceedings. Art. 17 para. 1 point 6 of the Code of Criminal Procedure clearly states that the proceedings are discontinued if the statute of limitations has expired, said Szymon Banna, spokesman for the District Prosecutor’s Office in Warsaw.

The statute of limitations for the acts was confirmed by the District Court for Warsaw Mokotów in Warsaw, which upheld the prosecutor’s decision to discontinue the investigation and pointed out that regardless of the legal classification of the behaviors described by the victims, these acts were already time-barred at the time the notifications were sent to the prosecutor’s office.

Investigation into the “rape of two minors”

In February 2019, the District Prosecutor’s Office in Warsaw initiated an investigation into the rapes of two minor victims who were under 15 years of age. The crimes were allegedly committed between 1997 and 1999.

The proceedings were initiated following notifications from two women. The women who accused the pianist of molestation and rape performed as children in the programs “Tęczowy Music Box” and “Co Jest Grane”, as well as in the band “Tęcza”. The prosecutor’s office did not disclose the content of the notification.

At the beginning of November last year, the District Prosecutor’s Office in Warsaw announced that part of the investigation had been discontinued. The reason was the statute of limitations, and separate proceedings are being conducted for non-statute-barred acts.
