Warsaw. The court repeals the ordinance on paid parking in Saska Kępa and Kamionek. The governor is preparing an appeal

The Voivodship Administrative Court revoked the supervisory decision of the Mazowieckie Voivode, repealing the resolution on extending the paid parking zone to Saska Kępa and Kamionek. However, this is not the end of the battle. The voivode announces an appeal to the Supreme Administrative Court.

Recall: on April 14, the Mazowieckie Voivode stated invalidity of the resolution in its entirety introducing a paid parking zone in Kamionek and Saska Kępa. On April 20, at the session of the Warsaw Council, the councilors decided to appeal against the decision of the voivode to the Provincial Administrative Court.

The governor announces an appeal

On Friday, August 25, the Voivodship Administrative Court issued a judgment in which it annulled the contested supervisory decision of the Mazowieckie Voivode, and also ordered the Voivode to pay to the Capital City of Warsaw PLN 480 as reimbursement of the costs of court and administrative proceedings.

“The case was considered at a closed session, it will be possible to learn the reasons for the Court’s decision only after the justification has been prepared” – informed the Provincial Administrative Court.

The judgment is invalid. The parties to the proceedings will be entitled to appeal against it to the Supreme Administrative Court within 30 days from the date of delivery of a copy of the judgment with justification.

Damgara Zalewska, spokeswoman for the Mazowieckie voivode, confirmed in an interview with tvnwarszawa.pl that the voivode will appeal to the Supreme Administrative Court.

– The judgment of the Provincial Administrative Court confirms that we act in accordance with the law – assessed the spokeswoman for the Warsaw City Hall, Monika Beuth. – This is also good news for the residents of housing estates in Praga Południe, because the introduction of a paid parking zone makes it easier to park a car near the house, examples of which we have in other districts where SPPN is already present – she added.

“Without doing any analysis”

The Mazowieckie Voivode, informing in April about the recognition of the city council’s resolution on the SPPN as invalid, cited as reasons, among others, residents’ objection, lack of current analyzes, and incorrect way of adopting the resolution.

The vice-president of Warsaw, Michał Olszewski, pointed out that the city is not only surprised by the questioning of the resolution itself, but above all by its justification. – It happens very rarely that, without any analysis, the voivode makes a decision based solely on the materials that appeared in the media and on the submitted draft resolution and minutes from the session of the Warsaw Council – he noted.
