The construction of a 96-meter apartment building near the Zgrupowania AK “Radosław” roundabout has been suspended. The spatial order commission of the Warsaw Council issued a negative opinion on the investment project. The investor withdrew his application submitted under the “lex developer” act, but announced that a new one would be processed.

The Libero high-rise building was to be built at the intersection of Burakowska and Młocińska streets, in the immediate vicinity of the Zgrupowania AK “Radosław” roundabout on the border of Wola and Śródmieście. It is a prestigious and convenient location, right next to a public transport hub.

As “Gazeta Stołeczna” recently recalled, the owner of the plot – Green Property Group – originally wanted to build a 120-meter office building there. However, the investor's plans changed. He proposed a lower building – 96 meters high, but with a residential and service function. Due to the fact that the local development plan allows only office development with services and trade in this place, the investor submitted an application for a permit to carry out a residential investment under the “lex developer” act, which allows the provisions of the plan to be circumvented. However, the local government must agree to this.

The spatial order committee of the Warsaw Council showed the investment a red card.

Too far from schools, too close to the cemetery

Previously, the developer's application was twice negatively assessed by the Municipal Urban Planning and Architectural Commission. The draft resolution refusing to determine the location of the investment states that serious doubts were raised by, among others, way of arranging greenery. The commission decided that the one located in the immediate vicinity of the large roundabout would not fulfill its recreational function due to the noise there.

“The Commission also noted that the area of ​​the planned investment is located in the noisy zone of the communication system, away from recreation areas, schools and kindergartens, which can be accessed through main streets heavy with traffic,” – explained in the justification for the draft resolution.

The conservator also had his comments. “The Masovian Provincial Conservator of Monuments pointed out that such high buildings in the vicinity of the monuments in question will negatively affect the perception and scenic exposure of the Powązki Cemetery and the high greenery located in this area” – explained in the justification.

The developer withdrew the application, but there will be a new one

The draft resolution refusing to determine the location for the investment was to be debated at the Thursday session of the Warsaw Council, but it was removed from the schedule after the meeting began. Vice-President of Warsaw Aldona Machnowska-Góra announced that the investor of the apartment building withdrew its application.

We asked Green Property Group what its plans were for the plot. Will a taller, 120-meter office building be built in this place instead of the apartment building, which received a negative opinion from the spatial order commission?

– We will work on this withdrawn application. Construction of an office building is an option, but regardless of this, we want to be able to construct a residential building in this place based on the special act – Wojciech Nowakowski, a representative of Green Property Group, replied to us. – The application will be processed again at the level of all municipal units – he added.
