The prosecutor’s office accuses Klementyna S., one of the leaders of the National Women’s Strike, of destroying the facade of the historic church at Plac Trzech Krzyży, pouring paint over a policeman and breaking into the territory of the Constitutional Tribunal. Two bills of indictment have been filed with the Warsaw-Śródmieście District Court.
Klementyna S. had the status of a suspect in two proceedings conducted by the downtown district prosecutor’s office. Both were completed in the last days of September with indictments against the court. The first concerns the situation from the protest before the Constitutional Tribunal against the tightening of the abortion law, which took place on January 28, 2021. – Klementyna S. is accused of violating the bodily integrity of a police officer in Warsaw at Aleja Szucha by splashing red paint on the uniform – informs prosecutor Aleksandra Skrzyniarz, spokeswoman for the District Prosecutor’s Office in Warsaw. According to the findings of the investigators, as a result of S.’s actions, “the uniform of the officer became unusable”.
In mid-September, S. claimed that the key evidence in her case had been destroyed. “I was accused of violating the inviolability of a police officer by staining my uniform. My lawyer asked for evidence in the form of a uniform. The request was rejected because the uniform was damaged,” she wrote on Twitter. Bartosz Lewandowski, a lawyer representing the injured policeman, referred to her entry. The attorney maintained that “contrary to the allegations, the uniform was photographed in detail and inspected”.
The OSK leader is also accused of “breaking into the fenced area belonging to the seat of the Constitutional Tribunal” on the same day. Thus, the indictment also covered Przemysław S. and Łukasz S., who were to enter the territory of the Constitutional Tribunal together with Klementyna S..
Responsible for the lightning on the facade of the church
The second indictment concerns the situation in Plac Trzech Krzyży. – In a separate proceeding, Klementyna S. was charged with damaging the monument by painting a red lightning bolt on the facade of the church of Saint Alexander at Trzech Krzyży Square in Warsaw. The church has been entered in the register of monuments since July 1965, the prosecutor Skrzyniarz said.
Pursuant to Article 108 of the Act on the Protection of Monuments, a person who destroys or damages a monument is threatened with from six months to eight years in prison.
A wave of protests after the tightening of the abortion law
Since October 22 last year, protests have been taking place across the country in opposition to the tightening of abortion laws as a result of the decision of the Constitutional Tribunal, headed by Julia Przyłębska. The opposition and many constitutionalists claim that the Constitutional Tribunal was cast incorrectly, including so-called doubles judges.
In its justification, the CT indicated that the probability of severe fetal defects was not sufficient to permit abortion. After the judgment was published, the provision of the so-called anti-abortion act, which allowed abortion in the event of severe and irreversible impairment of the fetus or an incurable life-threatening disease, lost its force.
