On Wednesday, a final verdict will be passed in the case of the murder of a youth councilor of Lublin. His partner is on the stand and sentenced to 15 years in prison in the court of first instance.
The trial of a lawyer convicted of murdering her partner started in November at the Court of Appeal in Warsaw and was held behind closed doors because the court decided to exclude the public.
As PAP learned, the parties have already made their closing arguments, and a final decision in this case is to be made on November 22.
In the first instance she was sentenced to 15 years in prison
The first-instance judgment was passed before the District Court in Warsaw on January 23 this year. The court found Karolina B. guilty of murdering her partner, 21-year-old Igor K., and sentenced her to 15 years in prison.
– This is an adequate punishment – the court said then. He explained that the Penal Code provides for eight years in prison for murder, but this applies to special cases. – If, for example, the accused was a victim of violence by Igor, but no direct violence took place – he added.
The court recalled that the penalty of 25 years in prison is imposed for murder with motives that deserve special condemnation, with exceptional cruelty. – In this case, it is about one knife blow, inflicted under the influence of emotion, although not out of passion – explained the court.
Both the prosecutor’s office and the defendant’s attorneys appealed against this verdict, demanding a different classification of the act.
The court of first instance shared the prosecutors’ opinion that there was direct intent to kill, not a possible one, or – as the defense wanted – unintentional manslaughter. The latter qualification would mean a maximum of five years in prison, and if both sides appeal, the 26-year-old could receive both a higher or lower sentence.
He was found in the stairwell, bleeding
The indictment in this case was brought to court on April 8, 2022. According to investigators, 21-year-old Igor K. was injured on the night of April 29-30 in the building at ul. Sarmacka in Miasteczko Wilanów.
The man was found in the stairwell, holding his stomach, suffering from a stab wound and bleeding. Karolina B. was leaning over him. The building’s residents called an ambulance and the police. The injured party died after several dozen hours in the hospital. The investigation determined that the cause of death was a blow with a 15-centimeter blade.
