The hearings of witnesses will probably begin on October 2, because the earlier date did not suit everyone, the chairman of the Constitutional Accountability Committee, Zdzisław Gawlik, told the business editorial office of tvn24.pl. According to earlier arrangements, the ODK meeting was to take place on Tuesday.
– The meeting of the Constitutional Accountability Committee was not convened for Tuesday, there was only a rehearsal that it would take place today, but the date was postponed for procedural reasons – ZdzisĹ‚aw Gawlik told the editorial office of tvn24.pl.
He added that “witness interviews will probably begin on October 2, because not everyone was happy with the earlier date.” When asked how many people the committee plans to interview, he said that currently “there are over 50 names on the list.”
– We have a plan that invitations will be sent to witnesses in advance – 7 days in advance. (…) I suspect that it won't be easy, someone will get sick,” he added yesterday in an interview with PAP.
Several dozen people are to appear before the commission
In mid-September, the ODK established a schedule for work on the preliminary motion to the State Tribunal for the President of the National Bank of Poland, Adam Glapiński. The schedule does not currently include an item regarding the hearing of the President of the National Bank of Poland, Adam Glapiński.
The commission is to be held accountable by, among others, former presidents of PKO BP Zbigniew Jagiełło and Pekao SA Leszek Skiba, former president of BGK Beata Daszyńska-Muzyczka, as well as Krzysztof Pietraszkiewicz, former president of the Polish Bank Association.
The initial application for the Constitutional Tribunal for the President of the National Bank of Poland is processed by the Constitutional Accountability Committee. After conducting the proceedings, the Committee presents the Sejm with a report on its work, together with a motion to hold the person accountable before the State Tribunal or to discontinue the proceedings.
A resolution on holding accountable before the State Tribunal, among others, the President of the National Bank of Poland, is passed by the Sejm by an absolute majority of votes in the presence of at least half (230) of the statutory number of Deputies.
The resolution of the Sejm on holding accountable before the State Tribunal results in the suspension of the person concerned from his duties. In the spring Constitutional Tribunal challenged the regulations in this case.
Dispute over the State Tribunal for Adam Glapiński
NBP considers the allegations in the TS application to be completely unfounded and believes that the entire proceeding may paralyze the work of the central bank. In connection with the activities in this case, the NBP has filed notifications to the prosecutor's office about the suspicion of a crime being committed by the Speaker of the Sejm Szymon Hołownia and the chairman of ODK, Zdzisław Gawlik.
The Constitutional Tribunal also opposes the bringing of the head of the NBP before the State Tribunal, in its opinion the planned trial will be inconsistent with the Constitution.
The Constitutional Tribunal ruled at the beginning of this year that it was unconstitutional for the Sejm to pass a motion to bring the NBP president before the Tribunal to automatically suspend him from his duties. At that time, the judges also ruled that the rule that an absolute majority of votes in the presence of at least half of the statutory number of deputies is sufficient to bring the president of the central bank before the Tribunal is unconstitutional.
In March this year, the group PiS MPs filed a motion with the Constitutional Tribunal challenging four provisions of the Act on the State Tribunal and one of the regulations of the Sejm's regulations. Its essence, as indicated in the justification, comes down to the fact of “entrusting the preparation of the indictment of the President of the NBP before the Constitutional Tribunal, i.e. bringing the President of the NBP to constitutional accountability, to the Constitutional Accountability Commission of the Sejm, i.e. a political body par excellence”.
