Mistakes in election committees?

For several days, the media have been informing about controversies related to counting votes in some committees during the second round presidential elections.

One such case is the situation in the District Electoral Commission number 95 at Stawowa Street in Krakow, where the votes were attributed to votes cast in the second round of presidential elections at Karol Nawrocki and Rafał Trzaskowski.

According to the election commissioner in Krakow, Rafał Sobczuk, representatives of the regional commission reported to the city hall and the District Commission, which conducts explanations in this matter. According to media reports, irregularities could occur in several other committees.

The difference between the two candidates was over 369 thousand votes – Karol Nawrocki won 10 606 877 votes, and Rafał Trzaskowski – 10 237 286.

Election protests

According to the Constitution Supreme Court states the validity of the president's election.

So far, 28 protests have been received by the Supreme Court against the president's election. The deadline for submitting protests is June 16. The first two protests on Tuesday will be considered by the Chamber of Extraordinary and Public Affairs.

After changing the law during the rule of Law and Justice, it is the Supreme Court to find out the validity of the election to the Chamber of Extraordinary Control and Public Affairs. This chamber was established pursuant to the Supreme Court Act of 2017 and consists of, among others NeoSziędzy, i.e. persons appointed after 2017 to the office of a judge at the request of the politicized National Council of the Judiciary. The status of these judges is questioned by the government, as well as part of the legal environment. Minister of Justice Adam Bodnar He stated directly that, according to the judgments of the Court of Justice of the European Union and the European Court of Human Rights, the Chamber of Extraordinary Control and Public Affairs of the Supreme Court “is not a court”. According to the Electoral Code, if the Supreme Court adopts a resolution annulling the election of the President of the Republic of Poland, new elections are carried out on the principles and in the mode provided for in the Code. The decision of the Marshal of the Sejm on new elections is made public and announces in the Journal of Laws at the latest on the 5th day from the date of the publication of the Supreme Court.
