President Andrzej Duda announced the pardon of Mariusz Kamiński and Maciej Wąsik, wrote “Super Express”, quoting a fragment of the head of state’s interview, which is to be published in full on Monday. – Today Mariusz Kamiński He is in a very difficult health situation and is constantly on hunger strike. Maciej Wąsik he is also on hunger strike. I wish this would be stopped. If this can only be stopped by me simply pardoning them again, simply to save them, then I will do it, he said. Andrzej Duda in an interview, quoted by “Super Express”. The president expressed hope that Kamiński and Wąsik would return home “as soon as possible.” – I have already appealed to Minister Adam Bodnar because I created conditions for him to stop both men from serving their prison sentences. Unfortunately, he doesn’t take advantage of this. This is shocking to me. I consider it a brutal way of putting the matter, he said in an interview for “SE”.

He assessed that his 2015 pardon remained in force because it was applied in accordance with the Constitution.

Mastalerek straightens

This interpretation of the president’s actions was denied by the head of his cabinet, Marcin Mastalerek.

“Pardon proceedings are underway. President Andrzej Duda will make a decision immediately after receiving the opinion of the prosecutor general,” he wrote on Sunday before noon. 22 on the website X. Writing about exes PiS MPs he added that Adam Bodnar “by delaying and not releasing the MPs from prison is endangering their lives and health.”

Earlier, in an interview with Onet, Mastalerek said that “nothing changes in this matter.” – The President recently initiated pardons for Mariusz Kamiński and Maciej Wąsik based on the Code of Criminal Procedure. Nothing changes in this respect. The president is waiting for the opinion of the prosecutor general regarding the pardon, because these are the requirements for this legal path – said Andrzej Duda’s official in an interview with the portal.

In an interview with TVN24 after 21 Andrzej Stankiewicz from Onet also commented on this. – I need to let some air out of this balloon. The president was misunderstood, I talked to the head of his cabinet, Marcin Mastalerek, who told me that nothing has changed in this matter. Therefore, the president is not returning to the so-called constitutional pardon that he applied in 2015, being convinced that it is still in force and maintaining his decision to apply this longer procedure, i.e. a pardon based on the Code of Criminal Procedure – he explained.

As he said, “the president is still waiting for Adam Bodnar’s opinion, because this longer procedure requires the opinion of the prosecutor general.”

– This constitutional pardon would mean that Wąsik and Kamiński could be released any day now. I understand where all the fuss comes from. On the one hand, the president’s statement is indeed imprecise. Secondly, we saw (we heard – editor) under the detention center where Maciej Wąsik is staying or under the prison where Maciej Wąsik is staying, a statement Jarosław Kaczyński from a few days ago, which was perceived as criticism of the president, that the president chose a solution that may mean that they will spend up to a year in prison, i.e. the longer path of pardon. They will not stay for a year, but I repeat, nothing changes in this matter. Jarosław Kaczyński did not speed up the presidential actions – emphasized Stankiewicz. – So we are back to the starting point, i.e. we are waiting for Adam Bodnar’s opinion, which will probably reach the president within a few days – added the journalist.

The case of Kamiński and Wąsik

Both Mariusz Kamiński and Maciej Wąsik were legally convicted by the Warsaw district court for failure to fulfill their duties and exceeding their powers. This concerns the period from December 14, 2006 to July 5, 2007 and activities related to the so-called land scandal. During this period, Mariusz Kamiński was the head of the Central Anticorruption Bureau, and Maciej Wąsik was his deputy. Two other members of the then CBA management were also sentenced together with them.

On January 11, the President announced the initiation of pardon proceedings against Kamiński and Wąsik based on the Code of Criminal Procedure at the request of their wives. He also asked the prosecutor general to suspend the execution of the sentence and release them from custody for the duration of the pardon proceedings.
