Wrocław. Death of an inmate in a prison

The inmate's death occurred at the end of August in a prison in Wrocław. The convict behaved aggressively, and when the services tried to overpower him, he lost consciousness. The prosecutor's office has initiated proceedings and is investigating the circumstances of this incident.

The District Prosecutor's Office in Wrocław is investigating the death of inmate Damian Ch., which occurred at the end of August in one of Wrocław's prisons. The prosecutor's office conducts proceedings under Art. 155 of the Penal Code, i.e. unintentionally causing the death of a person.

“The death of inmate Damian Ch. occurred on August 29 this year in Prison No. 1 in Wrocław. During the proceedings, it was established that the inmate was clearly agitated and was behaving aggressively. Prison service officers had to overpower the man. During the operation, the inmate felt unwell. On “An ambulance was called and took him to one of the hospitals in Wrocław. The inmate died there.” – said Karolina Stocka-Mycek, spokeswoman for the District Prosecutor's Office in Wrocław.

An autopsy was performed, but preliminary results did not reveal the direct cause of death. The prosecutor's office is waiting for the results of toxicological tests. “Witnesses to the incident are being questioned and monitoring has been secured,” she added.

“Measures of direct coercion were applied to the convict”

“The convict in question behaved aggressively towards the officers and did not respond to the commands given to him. In response to his unexpected attack on the officer, threatening his safety and health, direct coercive measures appropriate to the situation, specified in the current legal provisions, were applied to the convict. During the inmate lost consciousness. The officers immediately initiated rescue measures, including resuscitation, which resulted in the restoration of life functions to the medical facility, there was another cardiac arrest, resulting in the death of the inmate,” informs us 2nd Lt. Paweł Cyrulik, spokesman for Prison No. 1 in Wrocław.

According to Cyrulik, in accordance with applicable regulations, prison employees informed the prosecutor's office, the police, the District Court and the penitentiary judge. Explanatory activities in the case are also carried out by specialists from the District Inspectorate of the Prison Service in Opole.

“The materials collected so far do not indicate that the officers using direct coercive measures exceeded their powers. No one was suspended from performing their official duties. All materials, including those from monitoring and body-worn cameras, were handed over to the District Prosecutor's Office for Wrocław Psie Pole, which is conducting proceedings in the case” – explains the prison spokesman.
