A former policeman, Mateusz C., heard a sentence of the year in prison for three years. He must also pay references from PLN 3 to PLN 20,000 to the victims. The man was responsible for the fact that when he was an officer, during an intervention on a home row, he fatally shot a 32-year-old man.

The verdict was passed on Tuesday before the District Court in Giżycko.
The case concerns police intervention that took place in December 2021 in Wydminy in Masuria. A two -man patrol, whose commander was Mateusz C., was directed to a home argument caused by intoxicated Tomasz N. In addition to him, in the apartment, his partner and three children.
“Mateusz C. fired a shot from a very close distance”
After entering the apartment, the officers tried to calm the aggressive Tomasz N .. When it did not result in it, they decided to cut him with handcuffs.
– Tomasz N. raised his arms up all the time and pulled out, so Mateusz C. extracted the weapon from the holster, and then unlocked it and measured it towards Tomasz N., shouting to calm down. This procedure also did not bring the result – said judge Adam Barczak, spokesman for the District Court in Olsztyn.
He added that the policeman put the weapon in the holster and used pepper gas for N.. Despite this, Tomasz N. still resisted and did not allow him to put his handcuffs.
– When the accused released Tomasz N., he attempted to leave the room. Between him and two wanting to overpower the officers again a struggle fulfilled again, as a result of which all three fell on the bed. At that time, Mateusz C. from a very close distance fired a shot towards Tomasz N. Kula hit him in the chest, causing a number of extensive internal injuries and as a result the death of a man. At the same time, the same missile, after passing through the body of Tomasz N., hurt to the left wrist accompanying the accused policewoman – added judge Barczak.
Mateusz C. did not plead guilty
The court in Giżycko decided that a policeman Mateusz C. “violated the basic, elementary duties incumbent on a police officer”.
– As a result of the failure to comply with duties and exceeding his rights by Mateusz C. Tomasz N. died, a police officer suffered injuries, and other people staying in the room during intervention, including children, were exposed to the risk of losing his life or severe damage to health – said judge Barczak.
He explained that errors in the police officer's behavior were to be that, among others He did not inform Tomasz N. about the consequences of non -compliance with the instructions of police officers, including the right to use direct coercion measures, and against the dissemination of weapons and shooting, he did not bring Tomasz N.'s partner and her minor children to a safe room. The policeman's fault also consisted in an insufficient assessment of the degree and scale of threats and risk.
– At the same time, the court had in mind as the circumstances soothing the accused's unknown, his impeccable service in the police – added the court spokesman.
Policeman Mateusz C. at the trial did not plead guilty. Before the sentence was passed, he was dismissed from work in the police.
The verdict is unlawful.
