“The court decided to dismiss the cassation appeal as manifestly unfounded and charged the convicted resident of Pułtusk (Mazowieckie Province) with the costs of the cassation proceedings,” the press office of the Supreme Court reported.
A long list of allegations
The crime took place in March 2021 in Wyszków County. The victim was a 21-year-old friend of the accused. The prosecutor's office accused him of three brutal rapes, depriving the victim of her liberty combined with particular torment, including beating with various objects, kicking, calling her names and threatening to kill her. He was also responsible for possessing amphetamines and giving drugs to the 21-year-old, and for threatening to kill the victim's partner and child. All this while being a recidivist.
In the appeal the verdict was slightly changed
In December 2021, the indictment was filed with the court. The trial was held in camera. In mid-January 2023, the Ostrołęka District Court sentenced the accused to a total sentence of seven years in prison, and also imposed a four-year ban on approaching the 21-year-old victim to less than one hundred meters and contacting her.
The investigators considered this verdict to be correct and did not file an appeal, but the defense attorney did. Similarly to the District Court in Ostrołęka, due to the good of the injured party, the appeal process before the Court of Appeal in Białystok was held in full secrecy. The justification for this verdict was also secret.
The verdict shows that the court reduced the sentence for one of the charges and acquitted the defendant of another. The charge was possession of drugs. However, the sentence for the most serious crimes was upheld.
Ultimately, the convicted person will spend 6.5 years in prison.
