Minister Ziobro talks about the “growing partisanship” of some judges. He did not mean those who listened to him – members of the neo-NCJ elected by politicians. At the meeting, which was held on his initiative, he attacked judges, among others, from the Iustitia Association.

The recordings of the meetings of the new National Council of the Judiciary are not of the best quality, but you can follow the proceedings. Minister Ziobro himself wanted this particular meeting. He argued that courts assess similar cases differently depending on who the accused is. – Growing politicization, and one could even say partisanship in the activities of some judges – assesses Zbigniew Ziobro, the Minister of Justice.

The new National Council of the Judiciary met quickly on this matter. And although the head of R, a school friend of Zbigniew Ziobro, assures that she stays away from politics, the judges say that we are dealing with manual control of the judiciary. – The National Council of the Judiciary, which has the duty to uphold the independence of judges, pays homage to the Minister of Justice, joins the election campaign at all – convinces Professor Krystian Markiewicz, president of the Association of Polish Judges Iustitia. – It’s not just that the minister notices it, that this is an election campaign, so it’s worth publicizing it. Most of the members of the new KRS – appointed after PiS’s changes – agreed with the minister’s opinion and a three-page resolution “on the standards of impartiality and independence of judges” was created. The resolution contained allegations against judges’ associations. – The public activity of some judges raises concerns of the National Council of the Judiciary – says Stanisław Zdun, a member of the National Council of the Judiciary. – Iustitia Association, Themis Association – that’s where those sinister paws that seek judicial independence are. The source of the problem

– This whole resolution is an emanation of the personality of the members of this illegal body, which is the neo-KRS. Some of these are weird obsessions. It’s partly peas and cabbage, says Maciej Czajka, Themis Judges Association.

There was no full consent of the National Court Register in the work on the resolution. – The resolution is simply off-topic. It is too vague and bears the characteristics not of a resolution of a constitutional body, but bears the characteristics of a publicist, says Paweł Styrna, a member of the National Council of the Judiciary. This rather journalistic nature of the document is also pointed out by the opposition. – I do not expect political journalism from the National Council of the Judiciary, but a very important body in Poland, in the Polish order, but the resolution of real problems. The real problem today is how long court proceedings last, says Szymon Hołownia.

Court proceedings are currently taking longer than when PiS started to govern. – For these eight years, Minister Zbigniew Ziobro and the National Council of the Judiciary take full responsibility – assesses Professor Krystian Markiewicz.

Today, this is not a problem for the KRS. The problem is that judges “contrary to the principle of impartiality engage in political activity.” – Confusing effects with causes. The current activity of a certain group of judges outside the court is primarily due to the fact that politicians have got into the judiciary, they are destroying it in all possible ways – explains Bogdan Zdrojewski, KO senator. Bodgan Zdrojewski is in the KRS on behalf of the Senate. In his opinion, the meeting of the Council was a court of judges. He explains that if it were not for PiS’s changes in the judiciary, judges could focus on adjudication.

– Me and my colleagues, my friend, politics do not care at all. We only demand that the constitution be respected in Poland, that the law be respected. Politicians are for politics, we are for justice. If politicians begin to administer justice, interfere in the administration of justice, try to appropriate what we have the right to, then we must put up a clear and simple resistance – says Maciej Czajka.

Further changes

The KRS made another important decision. – The council ordered the lustration of some cases, randomly selected, in order to find out the scale of the problem – informed Dagmara Pawełczyk-Woicka, president of the National Court Register.

The question is whether judges respect the principle of impartiality. This control is to be, among others, in the Poznań court that sentenced 21-year-old Marika, who was recently defended by Zbigniew Ziobro. – Today, the Minister of Justice is to be the one who is to assess whether the judge issued a good or bad sentence – adds Krzysztof Kwiatkowski.

PiS began changes in the judiciary immediately after coming to power. With such profound changes as the United Right has been talking about, judges would be re-appointed and there is a risk that some will be appointed and some – not necessarily.
