The Minister of Justice and Prosecutor General Zbigniew Ziobro gave a 24-year-old woman a break from serving a three-year prison sentence. According to “Gazeta Wyborcza”, she was convicted of “hooligan robbery”. The organization Ordo Iuris, which has launched a social campaign to pardon the woman, claims that she “pulled at the bag in LGBT colors”. When asked about the details of this case by a TVN24 reporter, Minister Ziobro did not want to give a precise answer.

Organization Ordo Iuris launched a social campaign on Thursday to convince the president Andrzej Duda to pardon Marika, a 24-year-old woman convicted by a Poznań court for robbery. For this purpose, a website has been created where signatures are collected for an appeal in this matter.

“Ordo Iuris presents Marika as a young and socially active student of the Poznań University of Technology, who in August 2020 protested in Poznań against the ‘ideological postulates of the movement LGBT‘” – writes “Gazeta Wyborcza”. “Together with three other people, in a gesture of opposition to the promotion of extreme left-wing ideologies, she tried to snatch a bag in the colors of the LGBT movement from a woman. She was subsequently prosecuted,” says Ordo Iuris.

The woman was sentenced to three years in prison. Ordo Iuris, referring to the sentence, believes that “it is impossible not to get the impression that when imposing such a penalty, the Poznań court was guided not only by the assessment of the act itself, but also by ideological considerations and the defendant’s personal attitude to the worldview”.

After a year of serving the sentence, the 24-year-old left prison as a result of the decision of the prosecutor general, which she is Zbigniew Ziobro. The law allows for a break in punishment during the course of the pardon proceedings.

On Saturday, Ziobro organized a press conference at the National Prosecutor’s Office, during which he spoke critically of the Poznań court before which the verdict was passed. He spoke, among other things, of “judicial robbery”. He also announced staff changes in the Poznań prosecutor’s office, which, according to the announcements, he is to announce on Monday. It’s about the prosecutor’s office, which brought the indictment to the court.

The Minister of Justice and the Prosecutor General also announced that an extraordinary complaint would be filed with the Supreme Court to challenge the final court judgment.

TVN24 reporter Sebastian Napieraj asked Minister Zbigniew Ziobro to indicate what exactly the woman was convicted of and what the situation looked like, which led her to the dock and then to prison. Ziobro sent the journalist to court files.

We had a chance to read the files. I’m sending you to the case file. The case is of a public nature, Ziobro said. – There was a dispute, there were emotions, there were behaviors that are certainly related to the kind of disputes that arise between people with different views and manifesting their emotions – he added when asked about what happened between the perpetrators and the victim.

However, he did not give a specific answer to the question of what exactly happened. – There was a scandal of abuse of the law and the application of the law on robbery, dealing with the behavior of very serious criminals, criminals, towards a girl who had different views than the court, different from the prosecutor – he said.

The prosecutor general also did not answer the question whether the prosecutor’s office treated robbery as a qualification of the act for which the court then imposed a sentence.

“Gazeta Wyborcza” about Marika’s case

“Gazeta Wyborcza” wrote that on Friday she applied to the Poznań court for access to the files of the criminal case concerning the woman. The court did not consider the application. “On Saturday, however, we managed to get to some information, including the sentence. There is information that Ziobro did not want to provide. Perhaps because they destroy the image of a poor, persecuted student,” we read in the “GW” article.

According to the information obtained by “Wyborcza”, the court sentenced the woman “for an attempted robbery made jointly and in agreement” with three perpetrators.

Marika, together with the co-conspirators, “using violence in the form of pulling, pushing and twisting the third finger of the left hand”, tried to snatch the victim’s handbag. According to “Gazeta Wyborcza”, the victim and her companion resisted, which prevented the perpetrators from snatching the purse.

“As a result of the struggle, the attacked woman suffered injuries such as bruises on her hand and a sprain of the distal phalangeal joint of her left hand” – the details of the case file presented by “Wyborcza” are to be read. “The court emphasized that the attackers did not achieve their goal only because of the victim’s attitude, and their actions were hooligan in nature. This means that they committed a robbery attempt for a trivial reason, in public, thus showing a blatant disregard for the legal order” – writes a diary.

The minimum sentence is 3 years in prison

Robbery, whether or not successful, is punishable by imprisonment from 2 to 12 years. In the case of using a “firearm, knife or other similarly dangerous object or incapacitating agent”, as well as when someone “acts in a different way directly threatening life or together with another person who uses such a weapon, object, means or method” the minimum sentence is 3 years in prison.

§ 1. Whoever steals by using violence against a person or threatening its immediate use, or by leading a person to a state of unconsciousness or vulnerability, shall be punishable by imprisonment from 2 to 12 years. § 2. If the perpetrator of the robbery uses a firearm, knife or other similarly dangerous an incapacitating object or means, or acts in any other way directly threatening life, or together with another person who uses such a weapon, object, means or method, shall be subject to the penalty of deprivation of liberty for a period of not less than 3 years.

“Gazeta Wyborcza”: the convicted person did not appeal the sentence

The court in Poznań sentenced a woman and a man recognized as an accomplice to three years in prison in 2021, the lowest possible penalty for such a crime – writes “Wyborcza” and adds that the court also ordered the payment of a thousand zlotys to the victim and forbade the convicts to contact and approach the victim by two years.

“GW” also points out that “Zbigniew Ziobro did not provide this information to the public” and that he “hid the information” that the convicted woman did not appeal the sentence, which became final after a week.

“One of the people familiar with the details of the case told us that the current offensive by Ordo Iuris and Ziobro is adding ideology to a criminal act: – The attackers just wanted to steal the victim’s handbag” – writes “Gazeta Wyborcza”.
