Arkadiusz D. claims that he killed an unknown man with a necessary defense. The court did not believe him

– I didn't really want to hurt anyone, especially kill someone. I only stood up in defense of my dad – explained Arkadiusz D.

According to the court, however, you cannot talk about defense when you deal straight into the heart. – With such injuries, the chances of survival would not even exist if the blow was on the operating table – argued Anna Makowska -Plege, judge of the Court of Appeal in Gdańsk.

In his appeal, Arkadiusz D. obtained a prison sentence of 4 years higher than in the court of first instance.

A tragic event occurred two years ago in Brodnica. At night, a 30-year-old came to the tenement house in which the convict lived with his father, who wanted to regain the debt from a friend, but confused the apartment. There was a row. Arkadiusz D. grabbed the knife, he claims, in defense of his father.

– The accused could have assumed that his father's health or life was threatened, and he certainly had a holy right to repel the coup – argued Katarzyna Bórawska, defender Arkadiusz D.

The defense demanded acquittal, but the court decided that there was no necessary defense in this case. – When the accused dealt two blows, one in the shoulder, the other in the heart, he did not defend any goods of his father. (…) The act of the accused was only a retaliation – indicated judge Anna Makowska -Plege.

According to the court, at the time of pushing the convicted father, nothing threatened, and the man who confused the apartment, not only did not hurt anyone, but even left.

– Defense necessary – very often people try to justify some of their mistakes or their violence, their aggression – comments lawyer Piotr Walczak. – Every average reasoning person knows that a knife can be killed, especially if he agrees around the chest. Here we had two knife strikes, not one thing – notes the lawyer Bartosz Wojda.

The prosecutors demanded a much higher penalty – in their opinion, there are no mitigating circumstances in this case. – Life imprisonment, possibly a penalty of 25 years imprisonment and a decision of a million for compensation, or PLN 500,000 – said Martyna Skrzypek, plenipotentiary of the auxiliary prosecutor.

The defense of the convict is also dissatisfied, which is why the cassation of the sentence is possible. The prosecutor and defender agree in this case only in one thing: this is a random crime that should not have occurred.

The victim and the convicted person did not know each other. They have never even met before.
