A reasonable solution is for the party to receive the money that is not disputed, and to suspend the payment of this part of the subsidy until the disputed amount is resolved, said Paweł Gieras, a member of the National Electoral Commission, in “Rozmowa Piaseckiego”. He admitted that he did not really understand Jarosław Kaczyński's reaction. – The case is not over – he noted.
On Monday National Electoral Commission adjourned the deliberations on the election committee report PIS until “the constitutional authorities of the Republic of Poland systematically regulate the legal status of the Chamber of Extraordinary Control and Public Affairs of the Supreme Court and the judges participating in the adjudication of this chamber.”
The National Electoral Commission met after last week the Chamber of Extraordinary Control and Public Affairs of the Supreme Court accepted PiS's complaint against the National Electoral Commission's rejection of the report of the party's electoral committee from the 2023 parliamentary elections. Such a decision obliges the National Electoral Commission to adopt the report, but the status of the Chamber that adopted it has taken, is questioned, among others, by the current government and some members of the National Electoral Commission.
“This has been the practice so far”
– The practice so far has been such that when the National Electoral Commission rejects a report and this decision is not yet final, i.e. it has not been finally resolved by Supreme Courtuntil then the subsidy is paid, but with the deduction of the disputed amount that is the subject of the proceedings – said attorney Paweł Gieras in “Rozmowa Piaseckiego”.
When asked whether the Minister of Finance should transfer approximately PLN 16 million a year to Law and Justice, he repeated: – This has been the practice so far.
What will the minister do? “I don't know that,” he replied.

On Monday Jarosław Kaczyński he said at a press conference that the decision of the National Electoral Commission is “completely illegal.” – It is another step towards the liquidation of Polish democracy, because depriving one of the parties of a political dispute of funds is nothing other than the abolition of the principle of equality of competing political formations – said the PiS president. According to him, “the National Electoral Commission should change its previous decision and award us money. It did not fulfill this obligation, which means it committed a crime.” “Our patience has run out,” he said.
– I don't really understand Mr. Jarosław Kaczyński – admitted Gieras. – The case is not over. The matter requires a very important clarification of a fundamental issue. And being offended at the Commission for noticing certain problems is, in my opinion, a kind of abuse – he said.
