After nine years of sticking to the murder version at the last hearing, the prosecutor's office changed the allegation against Adam Z. and decided that he should only answer for not providing help. On Tuesday, the Poznań District Court is to announce a judgment in one of the most famous criminal cases of recent years.

Final speeches in the third trial regarding the death of Ewa Tylman were delivered on November 12, 2024. It was supposed that the verdict would be passed at the same time. However, this did not happen. The court decided to resume the wire and postponed the trial until January 29, 2025. At that time, two witnesses were questioned.

Now a verdict is expected.

The third trial began on October 30, 2024. The accused Adam Z. appeared in the courtroom. He refused to testify, so he was read from the investigation. During the first hearing, it was also recreated, among others The trial experiment carried out on December 2, 2015. The accused then traveled the same path that he was to go on the night of November 23, 2015 with Tylman. He was carried out when Adam Z. was suspected of abduction of a woman. After this experiment, it was decided to charge him a murder with a possible intention.

Adam Z. did not maintain what he said during the experiment.

What was the prosecutor's office and defenders in the end speeches?

After interrogating the accused, the parties did not apply for re -taking evidence that was already in the case file and which were the subject of evidence in the course of the first two hearing in this case. The court closed the cord. The court accepted one of the defenders to set an additional deadline for delivering final speeches. The parties gave the speech on November 12.

The prosecutor's office in the final speech requested a change in the legal qualification of the act accused of the accused – on art. 162 parish 1 kk, that is, it is disadvantageous – and the recognition of Adam Z. guilty of this crime and imposing him three years imprisonment. In addition, she applied for an award of 50,000. PLN for the victim aid fund and post -trade assistance and charging it with the costs of the trial and a court fee.

Defender of the accused advocate Ireneusz Adamczak, however, emphasized that the Poznań prosecutor's office suffered a “devastating defeat” in this case. He reminded that Adam Z. had already been acquitted twice by the District Court from the allegation of murder with a possible intention, because – as he pointed out – the prosecutor's office “From the beginning she had doubts and had no 100 % certainty or any evidence. “

He added that investigators had only circumstantial evidence in this matter. The second of the defenders of advocate Piotr Jóźwiak also pointed to the numerous errors of the prosecutor's office and emphasized that there was no evidence indicating any contribution to the accused to the death of Ewa Tylman. The defense requested the acquittal of Adam Z. both from the alleged allegation of murder with a possible intention, as well as – in the event of a change in the legal qualification of the act – for acquittal from the allegation of not helping.

Two acquittals, two appeals

Ewa Tylman disappeared in November 2015; After a few months, her body was fished out of Warta. Due to the significant distribution of corpses, experts were unable to clearly determine the causes of death. According to the prosecutor's office, on November 23, 2015, Adam Z. pushed Ewa Tylman from the escarpment, and then threw unconscious into the water. The murder accused of him with a possible intention is punishable by up to 25 years in prison or life imprisonment.

The trial of Adam Z. started in January 2017. The case was dealt with by the District Court in Poznań. In April 2019, the court found that Adam Z. did not kill Ewa Tylman and acquitted him from the allegation of murder with a possible intention. In January 2020, the Court of Appeal in Poznań annulled the judgment of the Court of First Instance and managed case for re -examination.

The re -trial of Adam Z. started in March 2021. The prosecutor's office in the final speech requested that Adam Z. be found guilty of the act accused of him and imprisonment of 15 years imprisonment. The defense, in turn, applied for acquittal, the proxies of the auxiliary prosecutor and the accused's guilt.

The judge emphasized, however, that “in the Court's opinion, these evidence also did not allow to assign guilt in the scope of not helping.”

– The fact is that at this moment the evidence taken in the case only allow us to state that they were actually both in the park, and we only have evidence that the victim in this park remained and the accused left the accused – emphasized the judge in the justification.

In December 2023 The Court of Appeal in Poznań again set aside the acquittal of Adam Z. – accused of the murder of Ewa Tylman – and referred the case to be re -examined by the Court of first instance. According to local media, the Court of Appeal stated that many mistakes were made at first instance. It was also indicated that Adam Z.'s first testimonies were sufficient to convict him for not helping.

Adam Z. spent 15 months in detention. He was released during the first trial.
