The accident occurred on December 18, 2023 around 6 am at a pedestrian crossing at the intersection of ul. Remedy with Załęska Street. The 14-year-old went to the bus stop, she was to go to school. She entered the pedestrian crossing – the traffic lights did not work then, the girl entered the lanes with a pulsating yellow light.

The pedestrian crossing is separated by an island. The teenager beat the first part of the belts, then entered the second. When she came halfway, she was impetuous in front of the Volkswagen Passat driver. The 14-year-old was rejected over a distance of several dozen meters. The car that hit her stopped a bit further.

The girl suffered a lot of severe injuries, she still has wires in her body, requires rehabilitation, before her more operations. – It is slowly recovering, we fight to make it as efficient as possible. Behind the military wheel

The driver was a professional soldier, so explaining the matter – as commissioner Magdalena Żuk, a press officer of the Municipal Police Headquarters in Rzeszów, told us, the Military Police in Rzeszów took care of.

All the evidence gathered, which was made at the scene of the accident and immediately after it, including a record from city monitoring cameras, which registered the accident, was transferred to the Military Police in Rzeszów.

The senior staff ensign Andrzej Łakomy, spokesman for the Military Police Department in Krakow, asked by us about the findings of the accident, only told us that the investigation “in the case of a road accident with the participation of a soldier driving a private motor vehicle” was conducted under the supervision of the District Prosecutor's Office for the Military District for the City 2023 events.

“Grossly low” sentence

As Krzysztof Ciechanowski, spokesman for the District Prosecutor's Office in Rzeszów, reported in an interview with tvn24.pl, an indictment in this case was sent to court in November last year.

The prosecutor's office accused the driver of committing an offense under Article 177 Paragraph 1 of the Penal Code, which concerns causing a traffic accident.

§ 1. Who, in violation of, even inadvertently, the principles of safety in land, water or air traffic, inadvertently causes an accident in which another person suffered injuries specified in art. 157 § 1, shall be punishable by imprisonment for up to 3 years old.

In the course of the proceedings, an expert for reconstruction was appointed road accidentswho calculated that the driver was driving at a speed of about 60 km per hour in the place where a speed limit of 50 km is required. So he was driving too fast. In the film from urban monitoring, it is also not visible that the driver releases before the pedestrian crossing, which he is obliged to.

On March 6, the District Court in Rzeszów found the driver guilty of causing an accident and issued a warrant in this case.

– 200 daily rates were punished for this act when determining the amount of one rate for PLN 30. In addition, the accused was imposed for the victim in the amount of PLN 5,000 and charged with costs in the amount of PLN 6309, PLN 64 – told us Tomasz Mucha, spokesman for the District Court in Rzeszów. – It should be noted that the reference is adjudicated regardless of compensation that can be claimed in civil proceedings – he added.

Due to the fact that, in accordance with applicable regulations, the order is not subject to justification, we do not know what the court was guided when issuing it.

– In this situation, I can only indicate that the court – by issuing a warrant – undoubtedly decided that on the basis of the evidence gathered the circumstances of the act and fault of the accused, they did not raise any doubts – judge Mucha told us.

There will be a process

A family wounded in the case of a girl and the prosecutor's office disagreed with the sentence.

– We assessed the verdict as incorrect, grossly low, the sentenced punishment is disproportionate to the committed act – prosecutor Krzysztof Ciechanowski said in an interview with tvn24.pl.

Dariusz Stec, father of the 14 -year -old: – I feel like I got a second time on the cheek: the first during the accident and now the second, when I met the verdict. In less drastic accidents, people get sentences, suspended penalties, a ban on driving, and this driver was punished only by a financial penalty. And what, daughter got compensation inadequate to what happened to her. This punishment is not educational in any way, if the perpetrators receive such penalties, they will mock the justice system.

Both the prosecutor's office and the proxy raised an objection to the court's judgment. They had such a right, and this means that there will be a trial in the case.

The prosecutor's office will apply for a suspended sentence and a ban on driving vehicles for the perpetrator of the accident.

– We expect a fair sentence and we will absolutely strive for him – the father of the victim told us in the 14 -year -old.
