On Monday, the District Court in Warsaw will deal with the application of the Sejm Investigative Commission for Pegasus to apply a temporary detention on the former Minister of Justice Zbigniew Ziobra. – Minister Ziobro provides arguments with his behavior – assessed the president of the Supreme Bar Council Przemysław Rosati.
The Warsaw District Court will deal with the application at 12 o'clock. – This is not just a matter that focuses on detention and forced bringing. Let us remember that Minister Ziobro has not appeared before, and in principle we should start with it – said Przemysław Rosati on TVN24.
He said that “absolutely basic duty of each of us is the obligation to appear on the call of the court, the prosecutor's office, the parliamentary investigation commission – every body that has the right to call a witness.” – Minister Ziobro with his behavior provides arguments that he absolutely disregards this basic duty – he added.
– This may be an argument that will be the basis for the court to reach for the furthest remedy to ensure. But it must also be honestly said that, according to the Code of Criminal Procedure, we must be able to state that there has been a persistent non -performance of the obligation to appear – he noted. Rosati, however, stipulated that “if it would be possible to achieve the same effect, i.e. lead to the appearance of witness Ziobro before the commission by stopping and forced bringing, then the arrest does not apply.”
Interrogation of Zbigniew Ziobra
Zbigniew Ziobro did not appear several times before the Commission for the Pegasus inquiry, and on January 31, despite forced bringing by the police to the Sejm, he came to the meetingwhen the commission has already finished the meeting. Investigation Commission, through the Prosecutor General Adam Bodnarsent a request to apply a detention of up to 30 days towards the former Minister of Justice to lead to his interrogation.
On February 20, a vote was held in the Sejm, where it was decided to repeal Ziobrze's immunity and consent to the arrest of him for 30 days.
Ziobro says that he did not resist and the commission did not want to question him, since it closed the meeting when he was on his way to them. – There was all the possibility to confront, you would call it testimonies, (…) But you didn't want it. You decided to organize a trap – he said in February in the Sejm, addressing the ruling majority.
The PEGASUS Remand Commission examines the legality, correctness and purposefulness of activities undertaken using this software, including by the government, special services and the police from November 2015 to November 2023. The Commission is also to determine who was responsible for the purchase of Pegasus and similar tools for Polish authorities.
