The end of “LGBT free zones”. The latest controversial resolution was infected in the Łańcut poviat

The councilors of the Łańcut poviat repealed the Local Government Family Rights Card on Thursday. After six years, all of the local government resolutions that agreed to the rights of LGBT people were repealed. – I feel great relief and satisfaction. I am very happy that this stage is coming to an end – comments Jakub Gawron, an activist fighting for the rights of LGBT people.

“The Łańcut poviat has just repealed the last local government card of family rights – thus ending the 6 -year chapter of explicit discrimination of LGBT+ people in Polish local governments. This is a historic moment – none of the resolutions hitting the LGBT+ community does not apply!” – she informed the campaign against homophobia on social media.

– I feel great relief and satisfaction. I am very happy that this stage is coming to an end. We experienced a great adventure with the Atlas of Hate – but this does not change the fact that there should be no resolutions at all – Jakub Gawron, a activist fighting for the rights of people, said in an interview with tvn24.pl LGBTco -creator of the hate atlas – an interactive map on which local governments were posted, which adopted so -called resolutions, positions or “anti -LGBT” declarations and the local government family rights card prepared by Ordo Iuris.

– Thanks to the efforts of many people, environments and communities, more than one hundred discriminating resolutions of anti-LGBT and cards of the Ordo Iuris families disappeared from Poland. These resolutions were an extreme manifestation of systemic discrimination of LGBTQ+ people – lack of marital equality, worthy of transit procedure, or protection particularly vulnerable to violence of rainbow families, queer teenagers, non -heteronormative seniors and seniors. This is still our reality – cut and uneven “Poland A, B, C and D” – which urgently demands change so that you can cook in it, do not co -do to come – adds Paulina Pająk, co -creator of the hate atlas.

The last resolution was repealed

The Łańcut poviat adopted the local government card of family rights on April 25, 2019. The councilors adopted the resolution “as an expression of the protection of the values ​​certified in the Constitution of the Republic of Poland, including the identity of marriage as a relationship between a woman and a man, protection of family and parenthood, the right to protect family life, parents' rights to raise children in accordance with their own beliefs and children's rights to protect against demoralization.”

In SKPR adopted by the Łańcut poviat, we read that “the family is the foundation of social order and the basic social community, which is an optimal environment of human development. It is a necessary support for all their members, especially the youngest and the oldest. No community is able to implement the common good without the participation of families. Our future depends on their good functioning.”

And further: “Local government is the foundation of a law.

Councilors in SKPR also included such a position: “We are on the side of the values ​​certified in the Constitution of the Republic of Poland – the identity of marriage as a relationship between a woman and a man, a family, parenthood and motherhood (Article 18), the right to protect family life (Article 47), Parents' rights to raise children in accordance with their own beliefs (Article 48 (1) and children's rights to the protection of demoralization (Art. 72 paragraph 1) “.

– All committees, although unanimously, were in favor of repealing this resolution – said Stanisław Panek, chairman of the Łańcut Poviat Council. Ultimately, the ratio of 13 votes, three against and with two abstaining councilors, the resolution was repealed.

Help the RPO and the European Union

Jakub Gawron reminded that an important role in the fight against resolutions against “LGBT ideology” was played by the Ombudsman Adam Bodnar. – Thanks to his complaints to administrative courts, a uniform case -law was created to exclude discriminatory resolutions from legal circulation. He rubbed the paths followed by his successor Marek Wiącek. The latter also issued an assessment position as SKPR as discrimination. It helped to repeal the last resolutions – noted the co -creator of the Atlas of Hate.

The Ombudsman Adam Bodnar in 2020 took the view that declarations and resolutions are inconsistent with the constitution and generally applicable law, because they discriminate against non -heteronormative and transgender persons, excluding them from the local government community, limit their rights and freedom and appealed to local governments to withdraw them. Several of them appealed to voivodship administrative courts.

Gawron also emphasized that the European Union also played a key role in the history of Polish “Anti-LGBT” zones. – The European Parliament adopted two resolutions calling on the Polish government and the European Commission to take action against anti-LGBT resolutions. European Commission adopted a provision in the partnership agreement prohibiting the financing of projects with the participation of JST, which adopted any discriminatory resolutions – he reminded.

Anti-LGBT resolutions meant that several local government units did not receive multi-million EU and Norwegian funds for planned projects. Corrulence of the tap with money is one of the main reasons why local governments began to withdraw from the controversial resolutions to agree to the rights of LGBT persons.

– The European Commission should maintain a provision in the new partnership agreement prohibiting the financing of projects with the participation of local government units maintaining discriminatory resolutions. He not only helped fight anti -LGBT resolutions, but also stops councilors from adopting resolutions against health education and the integration centers of foreigners – emphasizes Jakub Gawron.
