The court did not grant the request of the Pegasus committee for detention on remand for the former Minister of Justice Zbigniew Ziobro. According to the patron of Eliza Kuny, it is a “rational” decision, and its main reason was the documentation, which “minute after a minute indicated how the information was transmitted”.
Former Minister of Justice Zbigniew Ziobro did not appear several times before the Commission for the Pegasus inquiry, and on January 31, despite the forced bringing by the police to the Sejm, he came to the meeting when the Commission had already finished the meeting. Investigation Commission, through the Prosecutor General Adam Bodnarsent a request to apply a detention of up to 30 days towards the former Minister of Justice to lead to his interrogation.
The District Court in Warsaw did not accept the application of the parliamentary investigation commission for Pegasus about temporary detention for Zbigniew Ziobro. The chairwoman of the commission Magdalena Sroka announced an appeal.
On Tuesday, lawyer Eliza Kuna said on TVN24 that if they compared the situation from the investigation commission to a court situation, “at the moment when the court has information that the police were carrying a witness, the court manages a break and simply awaits this witness.”
She admitted that the attorney who defended Ziobra applied “reasonable procedural tactics”. – The representative asked the court to apply for full documentation from the Marshal's Guard and the police. This documentation – unfortunately for the commission – dispelled all doubts. Patron Kuna: It would be unreasonable to close the meeting for a witness to kiss the handle
– The attitude of a witness, which leads to the fact that you need to apply a means in the form of detention and bringing, is grossly reprehensible and there is no doubt about that. But if the entire state apparatus has already been involved, and here we were dealing with many policemen, (…) It would be an unreasonable court decision to close the meeting or hearing so that this witness kiss the handle – believes Gościni TVN24.
She added that only in exceptional situations the meeting is reorganized. – For example, when there are a dozen or so cases, other defendants are waiting, the court can reorganize the meeting. Here, however, we had a meeting of the investigation commission, where only one activity was to be carried out – hearing this particular witness – she said.
