Honorary blood donors are entitled to two days off. MP Bartosz Romowicz wrote in an interpellation that “employers report that some employees abuse their rights”. “The obligation to grant a dismissal is absolute” – replies Agnieszka Dziemianowicz -Bąk minister and work, adding that her ministry is currently working on “increasing the rights for such employees”.

MP Bartosz Romowicz (Poland 2050 – third road) in an interpellation addressed to health departments and family, work and social policy raised the topic two days off from work of honorary blood donors. One is due on the day of donation and the other on the next day.

“Employers report that some employees abuse their rights for donating blood under the Act – two days off, thus organizing the so -called long weekend, which takes place even several times a year” – we read. As the MP added, additional difficulties causes the lack of prior setting with the employer about the intention to donate blood, leaving the workplace without providing information about it, or situations in which the blood decides to give several employees of a given team at the same time.

Bartosz Romowicz asked in connection with whether it was planned to change the regulations in this matter or introduce compensation for employers.

Answer of the Ministry of Work

“The obligation to grant a dismissal is absolute. He also has an employer when the workplace has been suddenly accumulated or when the employer has to take organizational activities to replace the absent blood donor” – wrote in response to the interpellation of the Minister of the Family of Labor and Social Policy Agnieszka Dziemianowicz-Bąk.

“It should be emphasized that an employee who is a blood donor should not exercise his right in a way that prevents the employer from providing the work of the plant. .

You cannot make your right of use, which would be contrary to the socio-economic purpose of this right or the principles of social coexistence. Such action or abandonment of the authorized person is not considered to be exercised and does not benefit from protection.

The head of the MRPiPS also pointed out that in accordance with § 2 of the Regulation on the method of justifying absence from work and providing employees with dismissals from work, the employee should warn the employer about the reason and the expected period of absence from work, if the reason for this absence is known in advance or predictable .

“Considering the significance of the discussed case and its social dimension, currently the possibilities are being considered in the Ministry of Family, Labor and Policy introduction of solutions that increase employee rightswho honorly donate blood, “she informed.

Earlier, Deputy Minister of Health Jerzy Szafranowicz gave a response to the interpellation. He wrote that “honorary blood donation is a mission and responsibility. Blood cannot be bought or produced, which is why it is so important to give away its honorary donation” and encouraging and motivating this society.

“Blood donor should not exercise the right of non -honorary blood donation days in a way that could harm the employer, e.g. deliberately choose the days of the greatest job, so you should strive to agree on the deadline that will be accepted by both the employer and the employee – honorary employee Blood donor ” – he added.

“It should be noted, however, that it is good to consult the employer with the employer with a good practice, to consult the employer,” said the deputy head of MZ.
