The prosecutor's office discontinued the investigation against two young men detained after a deadly hit of 17-year-old Rafał on the Vistula boulevards. Both were suspected, among others, to make the investigation difficult. Only Gabriela, who was supposed to hurt a teenager, will answer before a court.

The case concerns the death of 17-year-old Rafał Z. The young man was stabbed with a knife on the Vistula boulevards in the region of the entrance to the Copernicus Science Center metro station. The incident occurred on September 27 last year. From the beginning, his condition was referred to as critical. Z. died three days later in the Prague Hospital.

Three people were detained in the case: 15-year-old Gabriela, 19-year-old Dominik and 19-year-old Adrian, residents of the Wołomin poviat. Everyone heard the accusations.

A row on the Vistula Boulevards

The District Prosecutor's Office in Warsaw announced on Tuesday that the investigation into two teenagers was discontinued. Men had previously heard allegations of obstructing criminal proceedings, not notifying the services of crime and not to help the victim.

Investigators tried to explain what exactly happened on the Vistula Boulevards. Their findings show that Gabriela, Adrian and Dominik participated in a friend's birthday on the so -called stairs on the Vistula in the area of ​​the Syrena monument. Around 10pm they decided to go home, went towards the metro station in the company of another man – Krystian.

Near the entrance to the metro station there was another group of 15-20 people. Rafał Z.

At some point, there was a quarrel between Dominik and Krystian and a man from the second group. At that time, Adrian and Gabriela stayed elsewhere. The situation began to escalate, the handles occurred. According to the prosecutor's office, Dominik was beaten and managed to escape to Adrian's group away. Then both of them were surrounded by aggressors.

– injured Rafał Z. joined the exchange of sentences, inserting his friend who was already participating in the quarrel. The minor Gabriela Z., who stood up for the suspects, also joined the conflict. She was then to argue with one of the girls from the other group that hit her in the face. During the incident, it is not clear at which moment, Gabriela Z. struck Rafał Z.'s butterfly knife – informs prosecutor Piotr Antoni Skiba, spokesman for the District Prosecutor's Office in Warsaw.

He adds that the conflict ended when the aggressors forced Dominik to kneel and apologize. Later, both groups diverged.

They went home, took nóź with them

– Gabriela, who was holding a distributed butterfly knife in her hand, joined the entrance to the entrance to the Copernicus Science Center. Adrian, who knew that this knife belonged to her, took him and then handed him over to Dominik, who hid him – describes Prosecutor Skiba.

At that time, the victim Rafał told his friends that he was stabbed with a knife. He showed a bleeding lower abdominal wound and slumped to the ground. The gathered began to help him and called for an ambulance. The police arrived around 23, previously medical rescuers arrived there.

The prosecutor's office reports that two “unknown men” from the Rafał group ran behind the suspects and Gabriela, trying to stop them at the metro station. However, it failed. They were pushed away, and all three drove away by train towards Bródno and went to Gabriela's house.

– When asked by Arkadiusz, what she did with a knife, Gabriela confessed that Rafał stabbed him while the Vistula boulevards came in – says the spokesman of the prosecutor's office. He continues to describe that the girl wanted to recover the knife, but the boy refused to give it back and said: “That she wouldn't ask about him anymore.” – Dominik gave the knife to Adrian. Both suspects took a taxi and got off on Chopina Street in Słupno, where Adrian again handed the knife to Dominik, asking him to keep him until the morning. At this point, the men parted, while Dominik took the knife and after returning home he hid him in a drawer in his room – reports the findings of investigators of the prosecutor Skiba.

They did not see how Rafał was hurt

All three – Gabriela, Adrian and Dominik – were detained the next day, i.e. 28 September 2024. During the search of Dominik's apartment, the police revealed a teenager belonging to the teenager.

Young men heard the allegations and went to temporary detention. Later, preventive measures used for them were converted into police supervision towards Dominic and a financial surety and a ban on contacting the other two for Adrian.

– Both suspicious men in their explanations denied that any of them could see the moment of stabbing the victim. They did not associate any of the aggressors, so they were unable to indicate Rafał's role in the whole incident – the spokesman of the prosecutor's office recalls their testimony. – Adrian admitted that he took a knife from Gabriela, who saw in her hand, but he was to do it so that she did not do something stupid, not knowing that Rafał had pushed him before. He also pointed out that he then gave him to Dominik, who confirmed his hiding at home – adds Prosecutor Skiba.

Difficult investigation, chaotic testimonies

Explaining the decision to discontinue the proceedings, the spokesman explains that the investigators struggled with difficulties in determining what exactly happened on the Vistula boulevards. – There was no impartial, indisputable evidence in the form of, for example, monitoring record, allowing to accurately restore the course of the incident involving suspects – he indicates.

Policemen secured the monitoring recordings, but the cameras did not record the moment of Rafał's knife stunning. – Investigators were forced primarily on the testimonies of witnesses and the explanations of the suspects, which were inconsistent, fragmentary, chaotic, and – which should be kept in mind – partly insincere – notes prosecutor Skiba

The problem was also to reach witnesses of the incident and people who took part in the scuffle. – Apart from the suspects, all established witnesses of the incident stated that they did not see the row and they did not know who participated in it. In the investigators' assessment, the content of the witness testimonies presented a dubious evidence – emphasizes the spokesman.

The prosecutor's office could not determine whether Rafał participated in the beating of Dominik. But investigators are sure that the boy took part in the event involving “entering verbal or physical skirmishes.” – During it, he conflict with Gabriela. It was established that the victim also had to be in a group of men attacking both suspects, as indicated by the moment in which he was lost with a knife. This had to take place during the whole incident – explains prosecutor Skiba.

Why was the investigation discontinued?

The prosecutor's office came to the conclusion that one could not be attributed to any of the suspicious perpetration of an offense under Article 162 of the Penal Code, i.e. not to help the victim. – It can certainly be said that when the suspects learned that Rafał was pushed with a knife, they were neither in place nor at a time when he realized their duty to help the victim – explains prosecutor Skiba.

The evidence gathered in the case also did not allow teenagers to attribute a crime to the failure of the offenses of crime. Investigators clearly determined that both suspects learned about the injury of Rafał under the house of Gabriela, when the girl admitted what she did. At that time, they did not know how difficult the 17-year-old is in.

– Bearing in mind that the suspects had knowledge of the event late in the evening, and in addition one of them was previously beaten, it seems acceptable that the report of the crime was made the next day. Meanwhile, all three were detained by the police the next morning – justifies the prosecutor Skiba. – In addition, the suspects could already rationally suppose that the event was notified of the relevant services, because when they saw the victim for the last time, he was in a group of a dozen or so people, of whom someone could already call the police and ambulance, which also actually took place, and therefore in this situation the suspects would benefit from the non -carbonism clause resulting from the article 240 of the Penal Code – paragraph 2 of the Penal Code – adds.

The situation is a bit different in terms of the last complaint regarding the obstruct of the investigation. According to the prosecutor's office, there is no doubt that both teenagers were going to hide the proof of the crime, i.e. the knife and in this way helped Gabriela in avoiding criminal liability.

Prosecutor Skiba describes that in this case procedural issues are an obstacle. Gabriela will be responsible for stabbing Rafał with a knife, but he will not be in court as an adult accused of a crime, judged on the basis of the Penal Code. The family court refused to refer the case to the prosecutor's office and decided that it would be considered based on the provisions of the Act of June 9, 2022 on supporting and resocialization of minors. For this reason, Adrian and Dominik cannot correspond to her as supporters. Both men were adult at the time of detention.

– For the above -mentioned reasons, the procedure against the suspect was discontinued – in relation to all acts accused of them due to the lack of the features of a criminal act – sums up Prosecutor Skiba.

The decision to discontinue the investigation is not final.
