Machines used in agriculture are not exempt from traffic rules – on the contrary, they apply to additional restrictions. Detachable vehicles must be properly marked, and their speed cannot exceed 30 km/h. Many municipalities also have time restrictions on heavy equipment. However, this is not the only aspect that farmers should pay attention to. One of the most burdensome effects of the presence of machines on the route is dirt of the surface. And this, as it turns out, not only a problem, but also an offense.

Pollution of the public road. The tariff is ruthless

Departure from a wet field straight to asphalt is everyday life in time wash agricultural. Unfortunately, it is very often associated with leaving mud, manure or plant residues on the surface. Although many hosts underestimate the problem, considering that “some earth has not hurt anyone yet”, the law says something different. Pursuant to art. 91 of the Code of Offenses, applicable from January 1, 2025:

Who contaminates the public road or on this road leaves a vehicle, or another object or animal in circumstances in which this can cause danger or a difficulty in road traffic, is punishable by a fine of up to PLN 1,500 or a reprimand.

However, that's not all. In practice, a policeman may also impose a penalty of up to PLN 200, and additionally oblige the perpetrator to clean up the pollution. If the situation is repeated, officers have the right to refer the case to court. And then there is no question of agricultural carelessness. Responsibility before the justice dimension is at stake.

For the driver, a dirty roadway is not only a matter of aesthetics or dirty wheel arches. The layer of the soil on a bend or wet asphalt is a ready -made slip scenario, especially in autumn, when visibility is limited and the path of slippery from rainfall or morning moisture. A seemingly innocent situation can quickly turn into a dangerous event. In such cases, the responsibility of the person leading a muddy tractor does not end with punishment financial. If the accident occurs and it is proved that the reason was left to be left, the prosecutor's office intervenes. Pursuant to art. 177 Penal Codefor violating the principles of safety in movement and causing an accident threatens up to 8 years imprisonment (if the result is death or severe damage to health).

And what to do if someone persistently leaves a “agricultural trace” on asphalt? It is not worth ignoring such situations. It is worth documenting them – photos, video recordings and dates can be used as evidence in the case of notification. The case can be referred to the commune office, report the police or notify the municipal guard. When the situation repeats, it is also possible to submit an official notification of the offense. Sometimes one well -measured mandate is enough to finish the mud saga once and for all and prevent the tragedy.
