“Wielki BU” demands an apology from Senator Krzysztof Kwiatkowski, but he did not appear in court

Patryk Masiak, a MMA player, known as “Great BU” sued Senator Krzysztof Kwiatkowski, claiming that he violated his personal rights. Demands an apology and compensation. The case concerns Kwiatkowski's statement about Masiak in the context of his acquaintance with Karol Nawrocki.

The case dates back to May 2024, when the photo aroused the photo, which Patryk Masiak, known as “Great BU”, took with the current PiS candidate for President Karol Nawrocki at the National Education Office IPN and published them on social media. The signature was “it was hard not to use the invitation, so since I was in the capital anyway, I came to see how Karol heads in this institution.” In August, he published a photo with Nawrocki at a cafe table and signature: “stuff with the president of the Institute of National Remembrance on a coffee. Wise is always good to listen to.”

Senator Krzysztof Kwiatkowski later spoke about the knowledge of Nawrocki with Masiak. The content of this statement, referring to Masiak's criminal past, became the basis for submitting a lawsuit to the District Court in Łódź for violation of personal rights. Masiak demands an apology from the senator, a ban on speaking about the plaintiff and his contacts with Nawrocki and PLN 50,000 compensation.

Sued the senator, he did not appear at the hearing

Masiak did not appear on Tuesday in a court in Łódź in a case he himself brought to Kwiatkowski. Therefore, the court decided that it would hear the case without the presence and testimony of Masiak. When the MMA player's representative announced that his client was abroad, representing the defendant Senator Kwiatkowski, lawyer Michał Ignasiak decided that since he did not justify his absence, he did not submit a request to postpone the trial, the court should skip his testimony, interrogate the defendant and close the case.

Judge Katarzyna Wesołowska-Zbudniewek accepted this conclusion, listened to what the defendant Kwiatkowski had to say, and watched the defendant presented by the defendant as evidence in the case of video materials with the statements of Senator Kwiatkowski and Masiak himself.

Kwiatkowski in his testimonies said before the court that he drew knowledge about the masiak from large publicly available public information portals that referred to the contacts of the PiS candidate for President Nawrocki and interviews with “Wielki BU”, who himself talked about his criminal past.

– All materials were publicly available, and I got the impression that the plaintiff was proud of his criminal past. He is a well -known player of cage fights, a public figure. He gave many statements, and in his social media he boasted his acquaintance with Karol Nawrocki – testified Kwiatkowski.

It was Masiak's contacts with Nawrocki that were to be – as Kwiatkowski testified – the essence of his statements about Masiak and speaking about him was guided by the good, which is the right of citizens to information about a person who can perform the most important function in the state.

Legal advisor Krzysztof Prosś representing Masiak requested that his client's claims recognize. He justified this by the fact that admittedly “he was convicted of kidnapping a woman and did not deny himself from it, but he was never convicted of pimping or participation in a criminal group”, and such a wording in his opinion was in Kwiatkowski's statements.

– There is a presumption of innocence. My client was not convicted of crimes that was attributed to him. We want the lawsuit that the defendant's statement was untrue and should not fall in public – said Podś.

The verdict is to be made in mid -April

Kwiatkowski's attorney demands the rejection of the claim in full, considering that the claim was not only proven, but has not even been substantiated. – We gave where the defendant got the knowledge, and the statement of Senator Kwiatkowski took place against the background of a public debate about the presidential candidate. Society has the right to information – said lawyer Michał Ignasiak.

He added that in his opinion “the offense shown by the plaintiff with the defendant's words is only articulated in the lawsuit.” – I do not see that the plaintiff takes any action to remove articles about his activities from the media – added Ignasiak.

In terms of assessing whether there was a violation of personal rights, the lawyer decided that the plaintiff was a public figure, and looking at how he creates and what language he uses, it is difficult to claim that his honor was violated. That is why he considers the action unfounded.

The judgment in this case will announce on April 15.
