– This stone will not be implemented in the dimensions designed by our predecessors in the KPO. We will not introduce simple contributions to all civil contracts, including contracts for specific work. The decision has already been made. Such a solution would burden employers and contractors with an amount of approximately PLN 5-7 billion – he said in an interview with money.pl Maciej Berek, minister in the Chancellery of the Prime Minister and head of the Standing Committee of the Council of Ministers.
But are the “garbage cars” staying? “Attempting to equate a contract for specific work with an employment contract is wrong”
The politician pointed out that in some professional groups, contracts for specific work are the basic form of employment (including in creative and artistic circles). – In Polish legal conditions, a contract for specific work can sometimes be a substitute for employment, but it largely applies to people who do not want to be employed under an employment contract. There are also situations when it is completely justified, e.g. when an artist is to make a monument or a bust, he will not want a full-time job. An attempt to equate a contract for specific work with an employment contract, also in terms of pension and disability insurance contributions, is wrong, Berek emphasized.
The minister announced that the Polish government would conduct a “difficult dialogue” with the European Commission. He emphasized that it is about the possibility of “rescaling it in such a way that it retains some of its rationality.”
What does Brussels say about this? The European Commission has explained that revisions of existing plans are possible in four cases: for countries that have not yet included a REPowerEU chapter in their plans and for those that want to transfer part of the cohesion funds to REPowerEU. Countries may also request a change to their plans if justified by objective circumstances or if they wish to allocate up to 6%. funds for STEP purposes, i.e. strategic technological goals (digitalization, development of emission-free energy sources or energy-saving technologies, biotechnology or quantum technology) – lists money.pl.
“Theoretically, Poland could therefore use the last point and indicate objective difficulties that prevent the implementation of this task. In such a case, an application for payment can be submitted and the milestones can be renegotiated at the same time,” we read. Unofficially, there is also a partial payment procedure, but then the milestone rolls over to the next payment and must be completed. Otherwise, the country loses a certain part of the allocation. “So, in the end, the government risks losing part of the funds if Brussels does not agree to the correction of the stone,” the portal writes. In an extreme case, it could be several hundred million euros.
Contributions for civil law contracts are a milestone of the KPO
According to unofficial reports, the act on the contribution of contracts for mandate and contracts for specific work was to be introduced in 2026. This is one of the so-called KPO milestones that the previous PiS government committed to achieving. This milestone is included in the fourth payment application, which, together with the fifth, is expected to be submitted by the end of this year. The amount is PLN 14 billion.
