The National Electoral Commission wants to exclude neo-judges from ruling on the PiS complaint. This is the report of the committee for the parliamentary elections

On Tuesday, the National Electoral Commission sent a request to the Supreme Court to exclude the judges of the Chamber of Extraordinary Control and Public Affairs of this court, appointed to hear PiS's complaint against the National Electoral Commission's decision, said Marcin Chmielnicki, spokesman for the National Electoral Office. This is about rejecting the report of the party's election committee for the 2023 parliamentary elections.

On Tuesday, spokesman for the National Electoral Office, Marcin Chmielnicki, announced that the National Electoral Commission had submitted an application to the Supreme Court on Tuesday morning. – In this case National Electoral Commission recognized that it is a party to the proceedings, so, as in every trial, the party has the right to request the exclusion of a judge – the spokesman explained.

According to unofficial information from the Polish Press Agency, the National Electoral Commission's request applies to all judges appointed to this case, as well as any other so-called neo-judges who may rule on this case or on the exclusion of judges from this case.

Court hearing scheduled for December 11

The press service of the Supreme Court had no knowledge of the receipt of the application after 1 p.m. – The hearing in this case is scheduled for December 11 – said Maciej Brzózka from the Supreme Court Information Center.

The questioned panel of judges was appointed in September. The rapporteur, Supreme Court judge Marek Dobrowolski, himself submitted a request for exclusion, but it was rejected – by another Supreme Court judge.

RMF FM was the first to report the National Electoral Commission's request to the Supreme Court. Chmielnicki also confirmed its submission on TVN24.

The National Electoral Commission rejected the report of the PiS committee

On August 29, the National Electoral Commission rejected the financial report of the PiS election committee from the 2023 parliamentary elections. At that time, Ryszard Balicki, a member of the National Electoral Commission, explained that the Commission, having no investigative powers, relies entirely on documentation presented by other state bodies. He said that the reasons for rejecting the committee's report included: PiS election campaigning during military picnics, an advertising spot of the Ministry of Justice and the election campaign conducted by employees of the Government Legislation Center. He added that the cases recognized by the National Electoral Commission as indisputably violating the rules of conducting an election campaign after recalculation resulted in the amount of PLN 3.6 million, which was included in the resolution.

PiS appealed against the National Electoral Commission's decision to the Supreme Court.
