Adam Bodnar with “important determination of the ABW” in the Pegasus case

The Pegasus system was used unlawfully – wrote Minister of Justice Adam Bodnar, citing the findings of ABW. Pegasus has not obtained the required Certificate of ICT security accreditation.

“Important determination of the ABW. The Pegasus system was used unlawfully. The Act on the protection of classified information provides that this system should be subject to ICT security accreditation. The certificate of such accreditation has never obtained” – wrote Bodnar.

The Internal Security Agency sent to the National Prosecutor's Office the results of the conducted inspection in the field of protection of classified information in connection with the Pegasus system. It was the results of this control that Bodnar described.

ICT systems in which classified information is to be processed are subject to the accreditation of ICT security provided by the ABW or SKW (military counterintelligence service).

The regulations take into account exceptions to the obligation to accreditation of security. He is not subject to systems located outside the protective zones, used directly to obtain and provide information in a self-respect and consolidation of evidence during the implementation of operational and reconnaissance or procedural activities by entities authorized to this.

The post -inspection of the Internal Security Agency indicated that the above exceptions could not apply to Pegasus software, because the elements of this system were in the protective zones of the Central Anti -Corruption Bureau.
