Adamiak: The envelope was received by the Ostrów Secretariat

On Thursday, a spokeswoman for the Prosecutor General took the floor in this case Adam Bodnar Prosecutor Anna Adamiak. She said that “the National Prosecutor's Office from the media yesterday found out that the deputy prosecutor general, prosecutor Michał Ostrowski, initiated criminal proceedings from the notification of the President of the Constitutional Tribunal Bogdan Święczkowski about the possibility of committing a crime of a coup d'état by the highest state officials.”

– We obtained this information from the media, so we took action to confirm this information. Today we found that on February 3 an employee of the Constitutional Tribunal personally came to the headquarters of the National Prosecutor's Office, and then submitted an envelope at the secretary's office of the deputy prosecutor general Michał Ostrowski. This fact of transferring correspondence was recorded by the secretary who works at the secretariat of this deputy prosecutor general – she added.

– This is a state of our knowledge confirming that it has been received by the prosecutor's office, and specifically to the Deputy General Michał Ostrowski some correspondence from the Constitutional Tribunal. Only the reference number agrees, because the envelope was recorded a signature, which prosecutor Michał Ostrowski in the media answered – explained Adamiak.

Adamiak: At the moment it is the private correspondence of Mr. Ostrowski

Adamiak explained that the provisions approved by the national prosecutor Dariusz Barski shows that “at the time when the correspondence received prosecutor Michał Ostrowski, due to the fact that he has no competence, i.e. – as we call it – he does not have devices for doing records and registration of documents, should provide this document with the relevant unit, which is competent due to the scope of the proceedings. ”

– It can be said that at the moment correspondence with an officially unknown content, which has received the Constitutional Tribunal, is the private correspondence of prosecutor Michał Ostrowski. These are world standards – said Adamiak.

Deputy Bodnar appointed by Morawiecki

Ostrowski, who initiated Święczkowski's investigation, has been held as deputy prosecutor general since November 2023. He was appointed by the then prime minister Mateusz Morawiecki (PIS). Ostrowski is one of the prosecutors who, together with the other deputies of the Prosecutor General, appointed in the time of Zbigniew Ziobra, signed the statements critical of the new power. Together, they submitted a notification, which became the basis for the initiation by the Regional Prosecutor's Office in Warsaw an investigation into the exceeding of entitlements by public officials, including the Minister of Justice, the Prosecutor General, by taking unlawful actions to dismiss Dariusz Barski from the function of the national prosecutor.

At the end of December, Prosecutor General Adam Bodnar directed three of his deputies – Ostrowski, but also Robert Hernand and Krzysztof Sierak – to work in the branches of the National Prosecutor's Office.

The Constitutional Tribunal in its current shape is criticized by the current authorities and some lawyers. On March 6, 2024, the Sejm adopted a resolution on the removal of the effects of the constitutional crisis of 2015-2023 and stated that “in the activities of the public authority of the CT-issued public authority issued in violation of law may be considered a violation of the principle of legalism by these organs.” Since the adoption of a resolution by the Sejm, the judgments of the Constitutional Tribunal have not been published in the Journal of Laws.

At the time of the first PiS rule (2005-2007), he was initially the head of the Office for Combating Organized Crime of the National Prosecutor's Office. Later – from September 2006 to November 2007 – Święczkowski was the head of the Internal Security Agency.
