The police are breaking the law, Jarosław Kaczyński said on Sunday during the celebration of the Smolensk monthly in Warsaw. – We cannot fight the police, we cannot attack the police as MPs, and it would be ineffective, anyway – said the PiS president. He repeated the thesis about the alleged attack near Smolensk, and called the shouts of counter-demonstrators “a gift for Putin.”

On Sunday, on the one-month anniversary of the Smolensk disaster, celebrations were held at Piłsudski Square in Warsaw, attended by Jarosław Kaczyński and leading activists of Law and Justice. A counter-demonstration was organized nearby, with participants holding banners with the inscriptions: “The Smolensk lie” and “We are fed up with dancing on coffins.” The protesters carried a wreath with an inscription blaming President Lech Kaczyński responsible for the disaster. The police were present at the scene.

During the PiS president's speech, shouts of “liar” were heard in the background. Kaczyński said that these shouts were “another gift for Putin” and “all those who organized this attack.” He added that it was a gift from Prime Minister Donald Tusk, who – as he said – “is addicted” to Putin, who “knows many different things about him”.

Kaczyński complained about the lack of reaction from the police. – For three months, the police, also physically, have been defending those who are placing a wreath here with an inscription offensive to the President of the Republic of Poland, Lech Kaczyński. Extremely offensive, Kaczyński said.

– We cannot fight the police, we cannot attack the police as MPs, and it would be ineffective. And therefore, in this way, we will now defend the truth about Smolensk and the dignity of those who died in Smolensk at Putin's hand – announced the president of PiS, adding that “the gang of criminals that rules Russia also has its representatives in Poland.” – Also among those in power, also among those who stand here – said Kaczyński. He added that “these are people who should be dealt with by the secret services and they, together with prosecutors and courts, should put them in the right place.”

– There will come a day when it will happen. Today we do not have such an opportunity and we simply do what we can do, we pay tribute to the president, we pay tribute to all those who died and at the same time we defend, but in this new way, the dignity of all subordinates, the dignity of my brother Lech Kaczyński, of blessed memory, and that is what we will do further, Kaczyński announced. He added that “the time will come when everything that is happening here will be treated appropriately and in accordance with the law.”

The PiS president said that people disrupting the Smolensk monthly anniversary with shouts “are breaking the law” because “you cannot disrupt the demonstration.” – The police also breaks the law, because the authorities who do not respect the law, who trample on the law, trample on the constitution, break the law – said Kaczyński.

Smolensk disaster

On April 10, 2010, 96 people died in the crash of the Tu-154M plane near Smolensk, including President Lech Kaczyński and his wife Maria, the highest commanders of the Polish Army and the last president of the Republic of Poland in exile, Ryszard Kaczorowski.

The Polish delegation was heading to the ceremony marking the 70th anniversary of the Katyn massacre.

Theses about the attack versus facts

He denied the theses pushed by Kaczyński and Antoni Macierewicz's subcommittee, which cost taxpayers millions of zlotys, in his reportage. “The Power of Lies” TVN24 journalist Piotr Świerczek, revealing recordings, photos and expert opinions commissioned by the subcommittee that were never included in its reports. These materials either directly exclude the attack or point to the disaster as the cause of the tragedy.

At the end of October, the Ministry of National Defense submitted to the National Prosecutor's Office a report on the work of the team established in this ministry to investigate the work of the Smolensk subcommittee, together with with 41 notifications about the possibility of committing a crimeresulting from identified irregularities in its functioning.

Prosecutor General Adam Bodnar has established an investigative team in the National Prosecutor's Office to deal with the notifications submitted by the Ministry of National Defense and the report on the work of the team assessing the activities of the Antoni Macierewicz subcommittee.

In 2010-2011, the causes of the Smolensk crash were investigated by the State Aviation Accident Investigation Commission chaired by the then head of the Ministry of Interior and Administration, Jerzy Miller. In the report presented in July 2011, the commission found that the cause of the disaster was a descent below the minimum descent altitude, which resulted in the plane colliding with trees, leading to the gradual destruction of the structure of the Tu-154M. According to the committee neither sound nor flight data recorders confirm the thesis of an explosion on board the plane.
