National Prosecutor Dariusz Korneluk announced that Prosecutor General Adam Bodnar twice asked his deputy prosecutor MichaĆ Ostrowski to issue documents related to the investigation into the suspicion of the “assassination of the state”. – I also see the possibility of committing a crime of hiding a document on my side – said Korneluk. He also emphasized that the deadline for issuing documents is this Monday.
The President of the Constitutional Tribunal Bogdan ĆwiÄczkowski announced on Wednesday that the Deputy Prosecutor General Adam Bodnar Prosecutor MichaĆ Ostrowski, after his notification, initiated an investigation into the suspicion of an assassination attempt among others by the prime minister, marshals of the Sejm and Senate, head of the Government Legislation Center and some judges and prosecutors. According to the President of the Constitutional Tribunal, the crime is that from December 13, 2023, these persons act “in an organized criminal group”, aimed at “changing the constitutional system of the Republic of Poland and acting to achieve or cease the activities of the Constitutional Tribunal and other constitutional bodies, including the National Court Register and SN “.
National prosecutor Dariusz Korneluk on Monday on “One on One” on TVN24 assessed that MichaĆ Ostrowski “does not respect any regulations within the prosecutor's office”. “I hope that Mr. Ostrowski, after this self -creation this week, will come to come to his senses,” he said.
The national prosecutor emphasized that neither he nor the Minister of Justice Adam Bodnar read the content of the notification submitted by ĆwiÄczkowski. – (Bodnar – ed.) Already twice asked MichaĆ Ostrowski to issue this notification, as well as the protocol from the interrogations of various people – he said.
He added that the deadline for issuing documents by Ostrowski is set by Monday. “The original date was already set on Friday,” he pointed out.

Korneluk expressed the surprise that the persons interrogated by Ostrowski agree to testify, “when the case in fact in the prosecutor's office was not registered.” Prok. Asked about possible consequences for the Deputy Prosecutor General for not issuing the indicated documents, Korneluk emphasized that Bodnar has a “full range of funds to be used.” – I also see the possibility of committing a crime of hiding a document on my side, because such a notification from the President of the Constitutional Tribunal is a document within the meaning of the Penal Code – he noted.
A spokeswoman for the Prosecutor General, prosecutor Anna Adamiak informed on Thursday that the prosecutor's office's findings show that on February 3 a CT employee personally came to the headquarters of the National Prosecutor's Office, and then submitted a closed envelope at the secretary of Ostrowski. On Thursday, however, the PG secretariat was received by a letter from Prosecutor Ostrowski informing about the initiation of proceedings to register this letter.
The Constitutional Tribunal in its current shape was and is criticized by the current authorities and some lawyers, indicating, among others, that it is situated in the judges of doublers (chosen as previously cast in the Constitutional Tribunal – ed.). At the beginning of March last year, the Sejm adopted a resolution in which he stated that “in the activities of the public authority of the CT public authority issued in violation of the law could be considered a violation of the principle of legalism by these authorities.”
Since the adoption of that resolution by the Sejm, the judgments of the Constitutional Tribunal are not published in the Journal of Laws. In turn, in the government's resolution adopted in December 2024, it was stated, among others, that the announcement of the CT decisions in the official journals could lead to the consolidation of the crisis of the rule of law. As added, “it is not allowed to announce documents that have been issued by an unauthorized authority.”
