Opposition representatives, but also the left -left candidate Magdalena Biejat recognize that the release of the former head of Rars Michał K. from detention by a British court means that the allegations made by the Polish prosecutor's office were unfounded. This is a false thesis, because the court in London did not assess the prosecutor's allegations. The investigation into RARS is ongoing and arrested.

The Master's Court in London, which conducts extradition proceedings against the former head of the Government Material Reserve Agency (RARS) of Michał K., decided on January 29, 2025 that the accused may leave the detention of bail. This decision in “Facts after Facts” on TVN24 commented on Senate Deputy Marshal and Left candidate for President Magdalena Biejat. She said that this was a “surprising message for her. “We were convinced that people who participated in the procedure on RARS, this is a criminal group. That people involved in setting tenders in the government agency of strategy reserves de facto created a mafia group” – said Biejat. Then she stated:

Now it turns out that the British court did not agree with the prosecutor's office.

And she continued: “So I don't know what happened here, but it is worrying that the British court did not recognize this reason. The question is whether the problem was on the side of the court or on the side of our prosecutor's office. I don't know it today.” After which Biejat once again emphasized: “Today I do not know what happened and I ask questions. Because either these accusations are serious, we have documentation that is irrevocable – I expect it to be – or not. And these allegations should be defend against each court regardless of whether it is a Polish or British or any other court. “

These doubts together with the thesis that “the British court did not agree with the prosecutor's office”, Biejat repeated in the post to X. Commented These are Journalist of Wirtualna Polska Patryk Michalski. “This is a statement that is really compromising for the presidential candidate.

A similar thesis – that “the allegations lost in the collision with the truth” – in the context of the London Court's decision presented PiS MEP Michał Dworczyk. “Michał Kuczmierowski will come out of custody after today's decision of the British court. The current power of the nozzle with political hatred and the desire for revenge, compromising themselves at every step. Fortunately, there are courts that rule fairly. Purely political motives and allegations lose in collision with the truth” – he wrote in X.

However, these politicians are not right, because the British court did not assess the quality or legitimacy of the charges of the Polish prosecutor's office at all. We explain what the Master's Court in London assessed, what is in the case of Michał K. dismissal after bail and what “libertarian preventive measures” are.

Already 27 allegations in the RARS scandal

In August 2024, the prosecutor's office issued a decision to present the former president of the Government Strategy Reserve Agency Michał K. This is related to irregularities around RARS and multi -million contracts of this agency, which without tenders were to be concluded with friendly companies. As part of this investigation, 11 people have been presented to a total of 27 charges so far.

Initially, the place of Michał K.'s stay was unknown, but on September 2, 2024 He was detained in London. Therefore, the Polish authorities asked for extradition. In response, the Municipal Court in London ruled that by the time of the extradition hearing Michał K. would remain in custody.

The court “changed the method of guaranteeing the presence”

Originally, the trial was to take place in February, but it was postponed to July 2025. The London court at a meeting on January 29, 2025 decided that Michał K. would not have to wait these few months in custody. For this to happen, he must pay 200,000 until February 5. pounds of security and 365 thousand pounds of property guarantee. In addition, the court ordered supervision, which means that Michał K. must, among others: – provide the address at which he will stay until the hearing – there will be a police hour from 23-5; – Every day at certain times to appear at the police station, – pass a passport and ID card in a police deposit, and thus stay in Great Britain, – have an active phone around the clock.

In the context of statements such as Magdalena Biejat or Michał Dworczyk, it is the key to The British court did not rule on the charges against Michał K. by the Polish prosecutor's office.

As the spokeswoman of the Prosecutor General Anna Adamiak explained, the court only “He changed the method of guaranteeing the presence of Mr. Michał K. in extradition proceedings from extradition detention into libertarian preventive measures“.

The Polish prosecutor's office “is not surprised”

A spokeswoman Anna Adamiak said in an interview with PAP that the Polish prosecutor's office is not surprised by such a decision of the British court. – Our experience of cooperation with Great Britain in the field of extradition procedures indicate that there is some time when the British court applies an extraditional detention, and after some time this arrest is repealed – she explained. She added that the awarded libertarian measures are “very, and even extremely restrictive” and guarantee the presence of Michał K. on the territory of Great Britain during the extradition process. If he breaks any of the obligations appointed by the British court, he will commit a crime in accordance with the law.

The change ordered by the court does not affect the allegations of the Polish prosecutor's office against Michał K. He is still accused, among others for participation in an organized criminal group and if in July the court in London will allow extradition to Poland, these allegations will be in the indictment submitted to the Polish court. Michał K. is threatened by up to 10 years imprisonment.

There are new detention on irregularities in RARS

And the Polish law enforcement authorities continue in the investigation into irregularities at the Government Strategic Reserve Agency. January 29 CBA officers stopped Another three people in this investigation – the National Prosecutor's Office said. As she said, the prosecutor will present the charges and interrogate them as suspects. “Details after completing the action,” the prosecutor's office pointed out. The detention of another three people in the investigation regarding irregularities at the Government Agency of Strategic Reserve took place at the behest of the prosecutor from the Silesian PZ PZ PK.

According to unofficial information, three detainees are Anna W., former director of the office of Prime Minister Mateusz Morawiecki, her husband and Paweł Kleszczewski, owner of the PR agency serving the State Treasury company during the PiS rule. According to Onet, Anna W. was to accept PLN 3.5 million in a bribe from Paweł Sz., The creator of Red is Bad – and he was supposed to agree to full cooperation with the prosecutor's office.

Tvn24.pl asked the National Prosecutor's Office to confirm the identity of detainees. “Until the end of activities with the participation of detainees, we do not provide any further information,” prosecutor Katarzyna Calaów -Jaszewska told us. However, the unofficial information of TVN24 shows that the director of the Morawiecki office Anna W., heard the charge of Article 231 of the Penal Code, which concerns the exceeding of the right by a public official.

Miłosz Motyk from PSL-TRYSIA ROAD, Deputy Minister of Climate and Environment, commenting on January 29 in “Drop over and” On TVN24, the decision of the British court to release Michał K. from custody, reminded that the allegations against him “are still in force and will have to answer for everything”. – The closest associate of Prime Minister Morawiecki is accused of setting up tenders, accused of embezzled public funds. I don't know if this is a reason to be proud for Mateusz Morawiecki – he added. – Further arrests of Mateusz Morawiecki's colleagues are not covering subsequent actions, but unfortunately proof of how this government worked – he said.
