The government has adopted a draft law aimed at increasing the sums guaranteed in insurance, the Chancellery of the Prime Minister announced on Tuesday.
The draft act adjusts Polish law to EU regulations on civil liability insurance for damages incurred in connection with the movement of motor vehicles – as indicated in a press release of the Chancellery of the Prime Minister.
Change for those applying for compensation
The adopted regulation assumes that injured parties will be able to claim compensation from the civil liability insurance of motor vehicle owners at their place of residence or registered office, even if the insurer is insolvent.
“These tasks have been assigned to the Insurance Guarantee Fund,” it was reported.
According to the project, the Polish Motor Insurers' Bureau will be responsible for paying compensation to persons injured as a result of events that occurred in the territory of another EU country or a third country in the event of the insurer's insolvency.
Guarantee amounts
The minimum amounts guaranteed in civil liability insurance will be:
– in the event of personal injury – PLN 29,876,400 for one accident, regardless of the number of injured persons,
– for property damage: PLN 6,021,600 per accident, regardless of the number of injured persons.
What is the sum guaranteed? In simple terms, it can be said that it is the upper limit of the insurer's liability. The liability of insurance companies is not infinite.
In the case of voluntary policies, the insurance amount is clearly stated in the contract and the insurer never pays more compensation than this amount. As for compulsory third-party liability insurance for car owners, the upper limit of insurers' liability is set by the state.
The draft law will introduce a uniform form for the certificate of claims history under third-party liability insurance for motor vehicle owners for all EU countries.
The new regulations are to enter into force 14 days after their publication in the Journal of Laws.
