Koszalin. An unlawful sentence about a man who slipped on the platform, the train cut off his leg

The District Court in Koszalin awarded PLN 500,000 compensation and less than two thousand zlotys for Mr. Marcin, who slipped on the platform, fell under the train and lost his leg. The accident occurred in December 2013, when the 31-year-old Mr. Marcin got off the train on an icy and unlit rail platform in Świdwin. He fell so unfortunately that the departing warehouse cut his leg. The train stopped only after several dozen kilometers.

Mr. Marcin was not present in court during the announcement of the sentence. His court battle lasted since 2015. After the prosecutor's accident, she discontinued the proceedings due to the failure to report the person responsible for the neglect that led to the accident. Therefore, none of the companies PKP She did not feel to pay compensation.

The man began a court battle for compensation, which would allow him, among others for the purchase of a prosthesis. Mr. Marcin has a leg amputated above the knee. The state reimbursed by the state is not enough to function normally.

On Thursday, the court announced a verdict. Judge Piotr Walenciak awarded compensation in the amount of PLN 500,000 (plus an additional interest), PLN 54,000 due to treatment costs and PLN 35,000. In addition, Mr. Marcin will receive a monthly pension of PLN 1908.

Elżbieta Kozłowska, legal advisor and attorney of the victim said that she was satisfied with the fact that the sentence was passed after so many years. – The court did not calculate the lost income of our client. We do not know yet whether he will appeal in this matter – she added.

The verdict is unlawful.

Tragedy on the platform

The man on December 7, 2013 returned from a business trip in Germany. Then Ksawery's orkan came over Poland. Railway traction was icy, trains had delays. The man got out of the last wagon. At the end of this train, no one was on the platform. After the accident, Mr. Marcin was very active in sports, he played in Ampfutbol. However, due to the lack of financial resources, he had to give up this activity.
